چکیده:
پژوهش حاضر با هدف بررسی ارزیابی شیوههای سنتی و نوین جبران خسارات در قراردادهای بیمه از منظر حقوق خصوصی انجام شده است روش اجرای پژوهش توصیفی و اسنادی میباشد یافتهها نشان دادند یکی از مهمترین اصول حاکم بر پرداخت خسارت در نظامهای حقوقی، اصل جبرانی بودن پرداخت خسارت است. به موجب این اصل، که هم درحوزه حقوق قراردادها و هم درحوزه حقوق مسوولیت مدنی به کارمی رود، پرداخت خسارت به منظور جبران زیانهایی است که به خواهان وارد گردیده، نه به روش سنتی تنبیه طرف ناقض یا محروم کردن وی از سودی که از نقض قرارداد کسب کرده است. این اصل کارکردهای متعددی دارد که از جمله آنها تعیین نوع خسارتهایی که طرف زیاندیده میتواند دریافت کند و نیز محدود کردن آنها است. بر کارکرد اخیر آثار متعددی مترتب میشود که ازجمله آنها میتوان این موارد را نام برد: خواهان باید متحمل زیان شده باشد؛ پرداخت خسارت باید مبتنی بر زیان خواهان باشد و نه بر سود خوانده؛ خسارت نباید از زیان تجاوز کند؛ وپرداخت خسارت جنبه تنبیهی ندارد. اصل مورد بحث با چالشهایی مواجه گردیده، اما هیچ یک از آنها نتوانسته است اعتبار آن را با مشکل جدی مواجه کند.

There are several effects on the latter function, among which the following can be mentioned: the claimant must have suffered a loss; Payment of damages should be based on the claimant's loss and not on the defendant's profit; The damage should not exceed the loss; Paying damages does not have a punitive aspect. The discussed principle has faced some challenges, but none of them have been able to face a serious problem with its validity.
