چکیده:
زمینه و هدف: دادرسی اعم از کار یا مدنی، از دو جزء اصول و تشریفات دادرسی تشکیل میشود که تشریفات را میتوان از متن قوانین استخراج کرد. یکی از پیکره های دادرسی تشریفات است که رعایت آن اجتناب ناپذیر و الزامی است. اصول متمایز و جدا از تشریفات و واجد ویژگی های کلی، دائمی، انتزاعی و ارزشی هستند.مواد و روشها: روش پژوهش حاضر، نظری و بهصورت توصیفی-تحلیلی است. گردآوری اطلاعات به صورت کتابخانه ای و با مراجعه به اسناد، کتب و مقالات انجام شده است.یافته ها: اصول دادرسی مدنی در ابتدا برای حکم شدن بر دعاوی در شرایط عادی (عدم نیاز به حمایت از یک طرف دعوی) طراحی شده اند؛ درحالیکه در فضای حقوق کار، اصل حمایت از کارگر حاکم است. اصل تساوی و برابری، سنگ بنای اصول دادرسی مدنی محسوب می شود؛ اما این اصل در فضای روابط کارگر و کارفرما تعدیل شده است.ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است.نتیجه گیری: اصول دادرسی، بنیان هایی هستند که در نظام حقوقی، آمره محسوب میشوند. هرچند در آئین دادرسی مدنی مجموعه ای از اصول بنیادین و آمره وجود دارد که در صورت رعایت نکردن آنها دادرسی منصفانه نخواهد بود؛ اما گاه با توجه به اصول خاصی که در مقدمة آئین دادرسی کار بدان اشاره شده است، اصول بنیادین مدنظر دادرسی منصفانه تحت الشعاع قرار میگیرد و چنانکه باید رعایت نمی شود.

On the other hand, principles are distinct and separate from rituals and have general, permanent, abstract and valuable characteristics.Materials and Methods: The current research is of a theoretical type and is descriptive and analytical; Also, the collection of information is library-based and has been done by referring to documents, books and articles.Findings: The principles of civil procedure are initially designed to rule on lawsuits under normal conditions (no need to support one side of the lawsuit); While in the space of labor rights, the principle of protecting the worker prevails. The principle of equality is the cornerstone of the principles of civil proceedings; While this principle has been adjusted a lot in the atmosphere of worker-employer relations.Conclusion: The principles of procedure are the foundations that are considered binding in the legal system. Although there is a set of fundamental principles in civil procedure, if they are not followed, the procedure will not be fair, But sometimes, due to the special principles mentioned in the introduction of the labor procedure, the fundamental principles of fair proceedings are overshadowed and not observed as they should be.
