چکیده:
زمینه و هدف: داوری یکی از روشهای مهم حل و فصل اختلافات تجاری به ویژه در عرصه بینالمللی است. هدف مقاله حاضر بررسی قواعد حاکم بر داوری تجاری بینالمللی در فقه و حقوق ایران و حقوق آمریکا است. مواد و روشها: مقاله حاضر توصیفی- تحلیلی است. مواد و دادهها به صورت کیفی است و از فیشبرداری در گردآوری مطالب و دادهها استفاده شده است. ملاحظات اخلاقی: در این مقاله، اصالت متن، صداقت و امانتداری رعایت شده است. یافتهها: یافتهها نشان داد در فقه بر اساس قاعده الزام امکان استفاده از داوری تجاری بینالمللی وجود دارد. از طرفی مقررات و قواعد داوری تجاری بینالمللی در خصوص حقوق و تکالیف داوران در نظامهای حقوقی ایران و ایالات متحده آمریکا تفاوتها و شباهتهای گوناگونی دارد؛ اما با اندکی تأمل میتوان دریافت که اصولاً شباهتها در امور شکلی و تفاوتها در امور ماهوی است. اختلاف رژیم حقوقی ایران و ایالات متحده آمریکا سبب تفاوت در نظام حقوقی حاکم بر داوری تجاری بینالمللی در این دو کشور است که امری کاملاً طبیعی است. نتیجهگیری: مبنای اصلی داوری و به خصوص حقوق و تکالیف داوران در ایالات متحده آمریکا توافق طرفین است که میتوان دلیل آن را نظام کامنلا در این کشور دانست. درحالیکه در ایران به دلیل وجود قوانین مدون گوناگون مبنای داوری قانون است و این امر در مسئولیت داوران نیز وجود دارد.
Background and Aims: Arbitration is one of the important methods of resolving commercial disputes, especially in the international arena. The purpose of this article is to examine the rules governing international commercial arbitration in Iranian jurisprudence and American law. Materials and Methods: This article is descriptive and analytical. Materials and data are also qualitative and data collection was used in collecting materials and data. Ethical considerations: In this article, the originality of the text, honesty and trustworthiness are observed. Finfings: In jurisprudence, according to the mandatory rule, it is possible to use international commercial litigation.The findings showed that the regulations and rules of international commercial arbitration regarding the rights and duties of arbitrators in the legal systems of Iran and the United States of America have various differences and similarities, but with a little reflection, it can be seen that the similarities are mainly in formal matters and the differences are in substantive matters. Conclusion: The main basis of arbitration and especially the rights and duties of arbitrators in the United States of America is the agreement of the parties, which can be attributed to the common law system in this country, while in Iran, due to the existence of various codified laws, the basis of arbitration is the law, and this is in There is also the responsibility of referees.
