چکیده:
زمینه و هدف: مطالبه خسارت عدم ایفای تعهدات از موضوعات محل اختلاف در فقه است که از منظر حقوقی نیز محل بحث و بررسی است. هدف مقاله حاضر بررسی امکان و شرایط مطالبه خسارت عدم ایفای تعهدات است.مواد و روشها: مقاله حاضر توصیفی تحلیلی است. مواد و دادهها نیز کیفی است و از فیش برداری در گردآوری مطالب و دادهها استفاده شده است.ملاحظات اخلاقی: در این مقاله، اصالت متن، صداقت و امانتداری رعایت شده است.یافتهها: یافتهها بر این امر دلالت دارد که در فقه چندان به بحث مطالبه خسارت عدم ایفای تعهدات پرداخته نشده و در کل میتوان به وجود دو دیدگاه در این خصوص قائل بود. برخی قائل به جبران خسارت هستند اما مشهور فقها چنین دیدگاهی ندارند. در فقه تاکید اصلی بر الزام اجرای عین تعهد است. حقوق ایران، ضمن تاکید بر الزم اجرای عین تعهد، فسخ قرارداد و مطالبه خسارت نیز پذیرفته شده است، اما قانونگذار در مواجهه با مسئلۀ خسارت به کلیگویی بسنده کرده است؛ قانون گذار ایران نه تنها انواع خسارت قابل جبران را به صراحت تعیین نکرده است، بلکه حتی در موارد تعیین شده نیز ضابطۀ ارزیابی خسارت را به دست نمیدهد؛ این درحالی است که انگار قانونگذار اصل وجود طریق جبرانی خسارت را در نقض تعهدات قراردادی نیز با قاطعیت در نظر نگرفته است.نتیجه: لازم است در حقوق ایران، با توجه به اینکه در بسیاری مواقع الزام به اجرای عین تعهد وجود ندارد، مطالبه جبران خسارت، روشهای جبران و ابزارهای ارزیابی خسارت به صورت دقیقتری مورد توجه قرار گیرد.
Background and Aim: Claiming damages for non-fulfillment of obligations is one of the disputed issues in jurisprudence, which is also a subject of discussion from a legal point of view. The purpose of this article is to examine the possibility and conditions of claiming damages for non-fulfillment of obligations.Materials and Methods: This paper applies a descriptive-analytical design using the library method.Ethical considerations: In this article, the texts’ originality of, honesty and trustworthiness have been observed.Results: The findings indicate that in jurisprudence, the issue of claiming damages for non-fulfillment of obligations has not been discussed much, and in general, Mihawan believed that there are two views in this regard. Iran's law, while emphasizing the need to perform the same obligation, contract termination and claim for damages are also accepted, but the legislator has been satisfied with generality when facing the issue of damages; Iran's legislature has not only not clearly determined the types of damages that can be compensated, but even in the determined cases, it does not provide the rules for assessing the damages; This is as if the legislator has not firmly considered the principle of the existence of a compensation method in the breach of contractual obligations.Conclusion: It is necessary in Iranian law, considering that in many cases there is no obligation to perform the same obligation, the demand for compensation, compensation methods and damage assessment tools should be considered more precisely.
