در سال های اخیر مهاجرت و تغییر در زندگی به هدف اقشار مختلف مردم در جوامع مختلف به ویژه کشورهای کمتر توسعه یافته تبدیل شده است. در این میان افرادی هستند که به دلایل مختلف به فکر پناه بردن به طرق مختلف می افتند و در این راه خطرات زیادی را متحمل میشوند. رد شدن از مرزهای صعبالعبور، خطر امواج خروشان دریا و افتادن در چنگال پلیسهای مرزی از جمله مواردی هستند که مهاجرین غیر قانونی را در مسیر رسیدن به آرمانهای مورد نظر تهدید میکند و در برخی موارد به قیمت جان افراد تمام میشود. مهم ترین سند بین المللی تصویب شده درباره پناهندگان کنوانسیون1951 ژنو می باشد که در آن حق پناهندگی را برای هر کس که به دلیل ترس از آزار و اذیت به خاطر نژاد، مذهب، ملیت، عقاید سیاسی و مذهبی سرزمین خود را ترک کرده و ساکن کشور دیگری هستند و به دلیل این ترس نمیتواند یا نمیخواهد به کشور خود برگردد به رسمیت می شناسد. همچنین بیان می دارد که دولت های عضو به هیچ وجه حق اخراج پناهنده به کشور خود را ندارند. با این شرایط سوال این است که مسئولیت بینالمللی دولتها در قبال نقض حقوق قربانیان مهاجرت غیرقانونی در حقوق بینالملل چگونه می باشد؟ یافته ها نشاندهنده آن است که حمایتهای مقرر در حقوق بینالملل در وضعیت کنونی برای حقوق مهاجرین غیر قانونی موثر بوده و کفایت می کند.

With these conditions, the question is, what is the international responsibility of governments for violating the rights of victims of illegal immigration in international law? The findings indicate that the protections stipulated in international law are effective and sufficient for the rights of illegal immigrants in the current situation
