در یک تقسیم بندی، جرایم بر اساس عنصر مادی، به جرم مشهود و غیر مشهود تقسیم می شوند که جرم مشهود با تعابیر دیگری در حقوق اسلام نیز وجود دارد. اما حقوقدانان داخلی آن گونه که باید، از ماهیت، ارکان و سایر موضوعات مربوط به جرایم مشهود بحث نکرده اند. از آن جا که مطالعات تطبیقی، نقش اساسی و مفیدی در تکامل علوم گوناگون از جمله حقوق دارد، این تحقیق به صورت تطبیقی انجام گرفته تا مسائل مربوط به جرایم مشهود را بهتر بررسی کند و از این طریق نقاط ضعف و قوت قانون داخلی آشکار گردد. لزوم اجرای سریع عدالت می طلبد که ضابطان دادگستری در برخورد با این جرایم، اختیارات ویژه ای داشته باشند؛ اما به دلیل اصل کرامت انسانی و رعایت حقوق فردی، محدوده این اختیارات باید روشن باشد. در پایان این پژوهش به این نتیجه خواهیم رسید که مقررات جرم مشهود، با مشابهت های فراوان در بیشتر قانون گذاری ها وجود داشته و حفظ نظم عمومی و مصلحت اجتماع، آیین دادرسی ویژه این جرایم را توجیه می کند.
According to a classification، the crimes are divided، based on material elements، into tangible and non-tangible crimes. The tangible crimes have been referred to and interpreted in the Islamic law in a variety of ways. However، domestic lawyers have not discussed theMaster of Applied Science، University of Shahrekord nature، elements and other topics related to tangible crimes. Given the fact that comparative studies play a key role in development and perfection of various sciences including law، this research has been conducted in a comparative manner so that various issues pertaining to tangible crimes could be studied and points of weakness and strength be identified. The need for doing quick justice requires all court officials to have special authority in dealing with these crimes but the extent of this authority should be well-defined and clarified not only in accord with the principle of human dignity but also to respect individual rights.
In closing، the conclusion drawn is that the rules regarding tangible crimes do exist with great resemblance to or in most legislations and that، maintaining law، order، and safeguarding public interest justify special procedures for these crimes.
