خلاصة:
اصل تفکیک رزمندگان و غیرنظامیان در مخاصمات مسلحانه، به عنوان اصل بنیادین حقوق بشردوستانه، نقشی اساسی در حمایت از غیرنظامیان در برابر خسارات ناشی از جنگ برعهده دارد. تداوم کارایی اصل تفکیک، مستلزم توانایی تطابق با پدیده‌های جدیدی است که هر از چندی و به لطف پیشرفت تکنولوژی در عرصه مخاصمات مسلحانه ظاهر می‌گردند. از جمله این پدیده‌های نوین، جنگ اطلاعات می‌باشد که بنا به ماهیت غیرفیزیکی و توانایی در ایجاد اثرات مخرب، موجب بروز تردیدهایی در رابطه با چگونگی انطباق‌یابی آن با اصل تفکیک، در صورتی که در جریان یک مخاصمه توسط یکی از طرفین مورد استفاده قرار گیرد، شده است.مقاله حاضر به بررسی چگونگی اجرای اصل تفکیک رزمندگان و غیرنظامیان در صورت به کارگیری جنگ اطلاعات در مخاصمات مسلحانه می‌پردازد.
Principle of distinction between combatants and civilians, as fundamental rule of humanitarian law, has a basic role in protection of civilians against destructive effects of war. For continuation of this ability, the principle of distinction is needed to comply with new phenomena, which thanks to advances in technology, nowadays appear in conflict areas.As one of these phenomena, the information warfare, for its non-kinetic nature and destructive effects, could create doubts about its compatibility with the principle of the distinction, when one of belligerent parties uses it against other.This paper examines how the principle of distinction between combatants and civilian can be implemented in this situation.
