خلاصة:
مصونیت و مزایایی که از دیرباز به دولت‌ها در خاک کشور دیگر و درباره سفارتخانه‌ها و نمایندگان آنها اعطاء می‌شد، در تنگنای روابط دولت‌ها باقی نماند و با پویشی نوخواسته در دو سده اخیر تابعان نوظهور حقوق بین‌الملل یعنی سازمانهای بین‌المللی را نیز دربر گرفت. بدین معنا که برای حسن جریان امور و ادارة بهتر سازمان‌هایی که ناگزیر باید در خاک کشوری مستقر شوند، مزایا و مصونیت‌هایی به آنها اعطاء شد.سازمانهای بین‌المللی یا کارکنان آنها همواره ممکن است از مصونیتها و مزایای خود سوءاستفاده کرده و در آستین این جامة دیبا، گاه پیاله پنهان کنند. به عنوان مثال کارکنان این سازمان‌ها در پوشش مزایای گمرکی خود اشیای غیرمجازی را وارد کشور میزبان کنند، یا در زیر چتر مصونیت، در مقر سازمان به انجام اعمالی خلاف قانون بپردازند.در برخورد با این پدیده، در وهله نخست می‌توان با نظارت و اقدامات پیشگیرانه مانع از وقوع سوءاستفاده شد و در صورت وقوع آن نیز به طرق مختلف نظیر صرف‌نظر کردن از مصونیت و فراهم آوردن امکان تعقیب برای دولت قربانی می‌توان به مقابله با سوءاستفاده برخاست و نیز پس از ارتکاب، راه‌هایی برای جبران خسارت و پرداخت غرامت در نظر گرفته می‌شود.
The privileges and immunities which states possessed in the territories of other states didn’t remain only between the first subjects of international law. It particularly in the recent two centuries included the new subjects i.e. International organizations which enjoy privileges and immunities in order to ensure their independence and proper functioning.International organizations and their officials can always abuse the privileges and immunities which they enjoy. For example they can under the exemption from customs duties import forbidden articles into host states or under the veil of immunity commit unlawful acts in their headquarters.Regarding the abuses, the first measure refers to supervisory and preventive measures and the secondary to the measures which the organizations and victim states can take in the cases of abuses such as waiving immunities and providing the possibility of prosecution by national courts and there are also some ways of compensating after the abuses take place.
