Abstract:
کارشناسی عبارت است از تشخیص و تبیین امری که مراجع قضایی، صلاحیت و توانایی اظهار نظر و نسبت به آن را ندارند. بر این مبنا کارشناس شخصی است حقیقی که در رشته خاصی تخصص و تجربه داشته و خدمات او در این رشته قابل استفاده باشد. نظر به ماهیت و هدف امور کیفری، کشف حقیقت در درجه اول اهمیت قرار دارد. از جمله طرق کشف حقیقت در این زمینه، ارجاع امر به کارشناس است. مقاله حاضر در دو بخش کلی تنظیم شده است. در بخش اول پس از تبیین مطالب و موضوعات مقدماتی مرتبط با کارشناسی، به تشریح مبنای کارشناسی می پردازیم و در بخش دوم نیز رایجترین موارد ارجاع امر به کارشناس و مبانی حقوقی مربوط به آن را تبیین می نماییم. در ایران قانون کارشناسان رسمی مصوب بهمن ماه 1317 اصلاحی سال 1339 و آیین نامه آن مصوب 1318 را می توان اولین قانونی دانست که درباره کارشناسی وضع گردید. اما در میان بسیاری از قوانین می توان شاهد مقررات متعددی با موضوع کارشناسی بود که در مقاله حاضر مورد تحلیل قرار گرفته اند. در این ارتباط مقررات قانون جدید آیین دادرسی کیفری فرانسه نیز به طور اجمالی بررسی شده است. منطق برخی از مقررات فعلی و نظر برخی از حقوقدانان حاکی از این است که کارشناسی، قطعی و یقینی نبوده و ادعای تردید و خلاف در برابر آن مسموع است. پس کارشناسی از جمله امارات محسوب می شود و ظن آور است. در عین حال، برخی از آرای صادره از دیوان عالی کشور و برداشت از مفهوم مخالف ماده 460 قانون آیین دادرسی مدنی، جنبه دلیل بودن کارشناسی را تقویت می کند. از سویی ارجاع امر به کارشناس، یک تشخیص موضوعی و اصولا بسته به نظر دادگاه است، اما هرگاه اثبات امری منوط به تشخیص کارشناس باشد قاضی باید جهت رعایت حقوق دفاعی متهم و سایر جهات دادرسی، تقاضای کارشناسی را بپذیرد. تشخیص وقوع جرم یا عدم آن، تعیین مسئولیت کیفری، تعیین مرتکب، میزان مسئولیت کیفری، تعیین رابطه سببیت، چگونگی شخصیت متهم، تعیین مقصر، احراز مرگ و تشخیص زمان آن، تشخیص جنون و اختلالات روانی و... رایجترین مصادیق ارجاع امر کیفری به کارشناس محسوب می شوند.
Judging is identification and explains of cases where jurisdictions do
not competence and ability to comment on it. On this basis, the expert
is a real person who has experience in specific fields and his services
in this field are available and useful. Due to the nature and purpose of
criminal affairs, the discovery of truth is first in importance. One of the
methods for discovery of truth in this context is referred to the expert.
The present paper is classified into two main parts. The first section, after
explaining the basic subjects and issues related to Judging, explains the
basis of judgment. Also the second section, explain the most common
cases being referred to the expert and legal principles relevant to it. In
Iran, the official experts law, that reformed in 1339, adopted February
1317 and its regulations adopted in 1318; can be considered as first legal
that has approved about Judging. But among the many rules it can be
seen several rules with Judgment subject that have been analyzed in this
paper. In this regard, new law of French penal and legal procedures has
been investigated briefly. The logic of some of the current regulations
and the view of some lawyers suggested that judgment was not definite
and certain and doubts and contrary against it is acceptable. So judgment
is suspicious. However, some of the opinions issued by the Supreme
Court and withdrawal of the opposite to the concept of Article 460 of
the civil procedure law will strengthen the reason of being judgment.
On the one hand, referred to the expert, is a subjective detection and
primarily depended on the vote of court. But when expert diagnosis is
essential for proving the subject, for respect the rights of the accuser›s
defense and other aspects of the hearing; judge should accept the
request for Judgment. Detection of crime or lack of it, determination
of criminal responsibility, determination of the offender, the degree of
criminal responsibility, determination of causality relationship, how the
defendant›s character, verification of death and detection the time of
death, diagnosis of dementia and psychiatric disorders and ... are the
most common examples of criminal referrals to Judgment
