Abstract:
حق حیات محوری ترین حق از حقوق بشری است که حتی ددر دوران اضطرار عمومی نيز قابل انحراف نيست. با اين حال ، سلب حیات از طريق مجازان اعدام و در عمليات پليس همچنان به عنوان واقعياتی اجتناب ناپذیر در جوامع انسانی به چشم می خورند؛ هر چنده که اولی رو زه زوال و دومی تابع قواعد حقوقی و امری بسیار سخت گيرانه ای است. مطابق قواعد عرفی حقوق بین الملل، سلب حیات در درگيری های انتظامی در شرايطی کاملا استثنایی و تنها با تحقيق دو شرط " ضرورت و تناسب" رافع مسئوليت کيفری ضاربین در نظر گرفته می شود. به علاوه تکليف دولت ها در صیانت از حق حيات افراد حاضر در قلمرو سرزمينی شان مستلزم انجام تحقيقات فوری، دقيق و مستقلانه در صورت استفاده از سلاح مرگبار در عمليات پليسی منتهی به سلب حیات یا جراحات جسمی شدید است اين مقاله ضمن ارایه چارچوب نظری حمايت از حق حيات در درگيری های انتظامی، با بررسی رویه نهادهای قضایی و شبه قضایی بین المللی به دنبال تبیین تکاليف دولت ها در موارد سلب حيات در چنین درگيری هایی است.
