Abstract:
اتحادیه اروپا از حیث توجه به ابعاد و آثار تحریم‌ها یکی از سازمان‌های حقوقی منحصر به فرد به شمار می‌رود. حقیقت آن است که این سازمان بین‌المللی که سابقه چندانی نیز ندارد در باب اصول و مبانی، شیوه‌های اجرا و نیز کنترل تحریم‌های وضع شده از سوی نهادهای اجرایی آن موفق به وضع اصول حقوقی محکمی شده است. نظارت مستمر نهادهای قضایی اتحادیه بر وضع تحریم‌ها منجر به طرح دعاوی متعددی شده است که حاصل آن یک رویه قضایی قابل توجه در عرصه حقوق بین‌الملل است. در این مقاله به طور اخص مسئله تعارض تحریم‌ها با حقوق بنیادین افراد و نیز تعارض احتمالی نظم حقوقی اتحادیه با سایر نظم‌های حقوقی بین‌المللی به ویژه شورای امنیت در کنار دیگر مسائل حقوقی مربوط به وضع و اجرای تحریم‌ها، مورد توجه قرار گرفته است و آراء قضایی ذی‌ربط هم در سطح دادگاه بدایت اتحادیه و هم دیوان دادگستری اتحادیه مورد بحث و مداقه قرار گرفته‌اند.
European Union is a unique regional organization in economic sanction matters. Concerning the bases, models and conditions of sanctions, the Union succeeded to create though legal principles. Continued control of the judicial institutions in the process of sanction imposing, resulted in the elaboration of an important jurisprudence confirming the bases of an "Etat de droit" in the Union as a whole. The Possible conflict between the independent legal order in the Union and the Sanctions ordered initially by the UN Security Council is one of the delicate debates in the present article. The place and function of the European judge in defending the human values, known as fundamental rights, on sanctions matters have been analyzed in details in this brief look on sanction process in the EU legal regime.
