Abstract:
تمثل المحكمة الجنائية الدولية ليوغسلافيا السابقة المنشأة بموجب القرار (827) لعام 1993 السابقة والمصادق عليها بموجب قرار مجلس الامن(808) لعام 1993 السابقة الاولى التي تفصل فيها محكمة جنائية دولية في الانتهاكات الجسيمة للقانون الدولي الانساني والقضايا الفردية المتعلقة باتفاقيات جنيف الاربع لعام 1949( ). وبغض النظر عن الظروف السياسية الدولية التي رافقت انشاء هذه المحكمة. إلا أن هذه المحكمة قد ساهمت بشكل واضح وجلي في توسيع احكام القانون الدولي الانساني من خلال الدور الكبير الذي مارسه قضاة المحكمة في تفسير احكام هذا القانون بشكل جعلها قادرة ان تسهم في تعزيز وتطوير القانون الدولي الانساني من خلال التقارب بين التفسير التقليدي والتفسير المعاصر لقانون النزاعات المسلحة بشكل اسهم في تطوير القواعد العرفية للقانون الدولي. مع محافظتها واعتمادها على الحماية الاساسية التي يوفرها القانون الحالي بشكل اتاح لها ملأ الفجوة بين المفاهيم التقليدية لمركزية الدولية بشان القانون الدولي الانساني ومهمتها بشأن مقاضاة الافراد عن الانتهاكات الخطيرة للقانون الدولي الانساني وفقا لمبدأ المسؤولية الجنائية للفرد , وتوسيعها وتأسيسها لمفاهيم مثلت تقدماً غير مسبوق تمثل في اقرار فكرة المشروع الاجرامي المشترك التي استخلصتها المحكمة من نص المادة (7/1( من النظام الاساسي للمحكمة الجنائية الدولية ليوغسلافيا السابقة كما سنرى لاحقاً. وسوف نحاول تسليط الضوء على المشروع الاجرامي المشترك من خلال الفصول التالية: 1- الفصل الاول: المحكمة الدولية الجنائية ليوغسلافيا السابقة. 2- الفصل الثاني: ماهية المشروع الاجرامي المشترك. 3- الفصل الثالث: المساهمة الجنائية والمشروع الاجرامي المشترك. 4- الفصل الرابع: اركان المشروع الاجرامي المشترك. 5- الفصل الخامس: المشروع الاجرامي المشترك في محاكمات الحرب العالمية الثانية والمحكمة الجنائية الدولية
The International Criminal Tribunal for the Former Yugoslavia (ICTY) established by resolution 827 (1993) and ratified by Security Council resolution 808 (1993) is the first international criminal court to adjudicate serious violations of international humanitarian law and individual cases related to the four Geneva Conventions of 1949, .
