Abstract:
در ضرورت نظارت به عنوان یک روش پیشگیری از بزهکاری، جای هیچگونه بحث و تردیدی وجود ندارد لیکن پذیرش اصل بر نظارت در امور عمومی منشأ تحول در سیاست مقابله با بزهکاری در سازمان ها و نهادهای عمومی خواهد شد. قبل از آن هم تردیدی نیست که در امور خصوصی و زندگی اجتماعی روزمره مردم اصل بر پرده پوشی، عدم تجسس، طهارت، پاکی، تقوای افراد جامعه، خیر خواهی و صحت رفتارهای آن هاست. اصل بر نظارت مبتنی بر اصل عدم خیرخواهی است که اهمیت امور عمومی و ضرورت پرهیز از ریسک به امید خودکنترلی افراد آن را ایجاب می کند. اصل بر این است که هر گونه نظار در امور عمومی اعم از نظارت الکترونیک، شنود، مامور مخفی و امثال آن در فضای اداری و حکومتی امری مجاز و ضروری است. بر خلاف تصور عموم،در آموزه های اسلامی اصل بر نظارت بر اساس فرض عدم خیرخواهی است که مقاله به بررسی و بیان ادله این امر در منابع اسلامی و آثار گسترده آن بر اتخاذ سیاست جنایی کارآمد در مقابله با جرایم در حوزه امور عمومی است.

Accordingly, the principle is based on the lack of investigation and overthrow of the affairs of others as a Quranic principle. Generally, it is believed that in the criminal policy of Islam, the principle of piety is everywhere dominant. And in public affairs, the transfer of affairs to qualified persons and pious will be tolerated.
