Abstract:
زمینه و هدف: یکی از مهمترین اغراض ازدواج تامین نیاز جنسی طرفین پیمان است. فقه اسلامی از دیرباز به موضوع نیاز جنسی در ازدواج و رفع آن، از دریچه حق و تکلیف نگریسته و ضمن متمایزساختن جانب زوج از زوجه، حقوق جنسی هر یک را به صورت جداگانه مورد ملاحظه قرار داده و سرانجام به ترجیح غالب طرف زوج به لحاظ اولویت در تامین نیازهای جنسی متمایل شده است. نظرات مشهور فقیهان حکایت از اطلاق حق بهرهمندی جنسی زوج دارد، حال آنکه در خصوص زوجه به کمترین سطح برخورداری اکتفا شده است. پژوهشهای فقهی یا با هدف توجیه این نابرابری با استناد به تفاوتهای تکوینی و جنسیتی نظر داشتهاند یا در تلاش هستند با ایجاد تضییق در اطلاق حق استمتاع زوج و دعوت غیر الزامی از زوج برای توجه بیشتر به نیازهای زوجه، زمینه نمایش همسنگی و تعادل را در تامین این نیاز فراهم آورند.
مواد و روشها: در این پژوهش به روش تحلیلی ـ توصیفی، ادبیات فقهی حاکم بر روابط جنسی زوجین مورد دقت و بازخوانی قرار میگیرد تا از این رهگذر روشن شود، با محورقراردادن مقوله تامین «سلامت جنسی» طرفین عقد ازدواج، ورود استنباطات فقهی در حوزه روابط جنسی زوجین و تعیین حدود و ثغور آن، تا چه اندازه مجاز و ممکن است.
نتیجهگیری: بر اساس نتایج این پژوهش میتوان گفت حقوق جنسی زوجین تنها بر مبنای تامین رضایت جنسی طرفین و در چارچوب معاشرت به معروف و خطوط قرمز شارع قابل تعریف است و چه بسا شایسته نباشد فقه اسلامی دامنه تکالیف خود را به تعیین کم و کیف استحقاق جنسی زوج و زوجه تسری دهد.
Background and Aim: One of the most important purposes of marriage is to satisfy the couples’ sexual
needs. Islamic jurisprudence has long viewed the sexual needs in marriage and its elimination through the
lens of rights and duties and meanwhile distinguishing husband from wife, it has considered the sexual rights
of both separetly and finally it has intended to the predominant preference of the husband in terms of priority
to satisfy sexual needs. The famous opinions of the jurists indicate the application of the husband’s right of
sexual enjoyment; however, in the case of the wife, the minimum level of enjoyment is sufficient.
Jurisprudential researches either aim to justify this inequality by referring to developmental or gender
differences or they try to provide the ground for showing equality and balance in satisfying this need by
creating a restriction on the husband's right to enjoy and inviting him unnecessarily to pay more attention to
his wife's needs.
Materials and Methods: In this analytical and descriptive research, jurisprudential literature ruling the
couples’ sexual relationships is carefully read and reviewed in order to clarify the importance of satisfying
couples’sexual health and also to what extent it is permissible and possible to enter jurisprudential inferences
in couples' sexual relations and to determine its limits.
Conclusion: Based on the results of this study, it can be said that the couples’ sexual rights can be defined
only on the basis of sexual satisfaction of both parties in the context of socializing and red lines of the
Shari'a, and it may not be appropriate for Islamic jurisprudence to extend the scope of its duties to
determining the quantity and quality of sexual merit of a husband and wife.
