Abstract:
بر اساس دیدگاهی که برخی از فقها بیان داشته‌اند، هر عملی که اذن شرعی داشته باشد؛ ضمان به دنبال ندارد و بر اساس آن قاعده‌ای با عنوان «الجواز الشرعی ینافی الضمان» در نفی ضمان ایجاد کرده‌اند. در مقابل برخی دیگر ملازمة بین جواز و عدم ضمان را نپذیرفته و در اثبات ادعای خویش به مواردی از اجتماع جواز و ضمان استناد کرده‌اند. در نگاه ابتدایی به نظر می‌رسد امام خمینی در برخی تألیفاتشان قائل به ملازمه و در موارد دیگر قائل به عدم ملازمه بوده‌اند، اما با نگاه دقیق‌تر روشن گردید که نظر استدلالی امام خمینی نفی ملازمه است. در این مقاله با بررسی نسبت بین مصادیق جواز و ضمان و نیز تحلیل مفهومی این دو، نظریة نفی ملازمه تأیید گردیده و ثابت شده است که استناد به «الجواز الشرعی ینافی الضمان» در نفی ضمان زیان‌های ناشی از فعل مجاز، صحیح نیست؛ بلکه ثبوت ضمان در هر موردی تابع بررسی اسباب و شرایط ضمان در آن مورد است.
Based on an approach presented by some jurists, any act with religious authorization does not need any guarantee or liability. To reject the need for guarantee, they have created a principle known as “Religious authorization is immune from Liability”. On the contrary, some other jurists have denounced interdependence of authorization and no liability. To prove their claim, they have attested to instances of the juxtaposition of authorization and liability. At the first glance, it seems that Imam Khomeini has both approved interdependence and non-interdependence of authorization and liability in his works. However, a second review reveals that Imam Khomeini by reason has rejected interdependence. In this paper, the theory of non-interdependence between the authorization and liability has been confirmed after a thorough review of the relations between instances of authorization and liability as well as conceptual analysis of the two. Therefore, it has been proven that resorting to the principle of “Religious authorization is immune from Liability” in rejecting the liabilities for the damages incurred through a legitimate act is not legally right; rather, applicability of liability in each case depends upon the investigation of the related ways and means in that case.
