Abstract:
عدالت و امنیت بین‌المللی حاکم بر جهان امروز را موضوعات مختلفی به چالش می‌کشد، معضلاتی نظیر تروریسم، نقض حقوق بشر و حقوق بشردوستانه، جنایت علیه بشریت، جنایات جنگی، سرکوب‌های خشن دولت‌های خودکامه و غیره همگی تاثیر بسزایی در نقض عدالت و امنیت کیفری جهانی ایفا می‌کنند که نیازمند اعاده وضعیت و مقابله و برخورد است. در این میان، نهادهای بین‌المللی نظیر شورای امنیت سازمان ملل متحد که از یک سو مورد اجماع جهانی باشند و نظریات و مصوبات آنها لازم‌الاجرا باشد و از سوی دیگر ابزار و قدرت مقابله با موضوعات نقض کننده امنیت و عدالت کیفری بین‌المللی را داشته باشند می‌تواند به عنوان یک راهکار متناسب تلقی گردد. در این پژوهش که به روش توصیفی و تحلیلی تهیه شده است، دریافتیم که شورای امنیت با استفاده از ابزارهایی نظیر نظریه مسئولیت حمایت و همینطور ظرفیت ارجاع پرونده‌های خاص به دیوان کیفری بین‌المللی و همینطور حق توسل به نیروی نظامی و انتساب آن به سازمان ملل که مورد اجماع کشورهای جهان می‌باشد، علیه مظاهر تهدید کننده عدالت و امنیت کیفری بین‌المللی وارد عمل شده است که مصادیق آن در مجموع در پرونده‌های رواندا، یوگسلاوی و نظایر آن قابل لمس است.

In this descriptive and analytical study, we found that the Security Council used tools such as the theory of responsibility and support, as well as the capacity to refer specific cases to the International Criminal Court, as well as the right to resort to military force and assign it to the United Nations. It is a consensus of the countries of the world, acting against the threatening manifestations of international criminal justice and security, all of which are palpable in the cases of Rwanda, Yugoslavia and the like.
