Abstract:
یکی از محورهای توسعه بیع، ناظر به قلمرو مبیع از اموال مادی به اموال غیر مادی است. کنوانسیون بیع بین الملل کالا تعریفی از"بیع" ارائه نداده و بر اساس مقررات قانون متحد الشکل تجاری امریکا، عقد بیع، عقدی تملیکی بوده و خریدار در ازای پرداخت ثمن، مالک کالا می شود. روش تحقیق تحلیلی - توصیفی است و سوال این است، آیا توسعه قلمرو مبیع از اموال مادی به اموال غیر مادی، با نظام حقوقی کشور ما تعارض دارد؟ به نظرمی رسد توسعه مفهوم بیع با گسترش قلمرو مبیع از اموال مادی به اموال غیر مادی، بدون اینکه با نظام حقوقی کشور ما تعارض داشته باشد، قابل توجیه بوده و از لحاظ مفهوم تفاوت دارد در نتیجه از لحاظ تعارض و مفهوم که تفاوت دارد قابل توجه است.

The Convention on the International Sale of Goods does not provide a definition of "sale" and under the provisions of the United States Commercial Code, a contract of sale is an ownership contract and the buyer becomes the owner of the goods in return for payment. The method of research is analytical-descriptive and the question is whether the development of the territory of the seller from tangible to the intangible property conflicts with the legal system of our country or the concept of sale is different in the International Convention on American Commercial Code? The hypothesis seems that the development of the concept of sale by expanding the territory of the seller from tangible to intangible property, without conflicting with the legal system of our country, is justifiable.
