Abstract:
پس از حوادث یازده سپتامبر سال 2001 ایالات متحده آمریکا و سایر دولتها اقدامات گستردهای را تحت لوای آنچه «جنگ علیه ترور» خوانده شد انجام دادند. این اقدامات، که در ظاهر برای جلوگیری از تکرار حوداثی مشابه با حادثه یازده سپتامبر سال 2001 انجام میشدند، از سوی بسیاری از صاحبنظران حقوق بینالملل و فعالان حقوق بشر مورد انتقاد قرار گرفتند. دولتهای مزبور در مقابل تلاش نمودند با استدلالهایی همچون لزوم حفظ امنیت و وضعیت ضرورت، اقدامات خویش را توجیه نمایند. این بحثها در سالهای اخیر بارها در محاکم مختلف حقوق بشری مطرح شدهاند و رویه قضایی قابل توجهی در محاکم داخلی و بینالمللی حقوق بشری در این خصوص شکل گرفته است. اکنون با توجه به این رویه قضایی میتوان به این پرسش پاسخ داد که آیا نقضهای حقوق بشر که در راستای مبارزه با تروریسم انجام میشوند، از منظر حقوق بینالملل و حقوق بشر موجه هستند یا خیر؟ در این مقاله تلاش شده است تا با توجه به رویه محاکم حقوق بشری در کشورهای مختلف، موضوع مبارزه با تروریسم و محدودیتهای آن مورد بررسی قرار گیرد.
The present study uses a comparative approach to explain the concept of peace and justice from the point of view of political philosophy. In this research Islam is considered the central slab. Islam as a divine religion, which draws the principles of justice for peace with the goal of prosperity and the perfection of human beings in particular in the private and public realms.
