Abstract:
زمینه و هدف: بزهکاری نوجوانان، پدیدهای است که به دلیل حساسیتهای خاص خود همواره دغدغه سیاستمداران و حقوقدانان کشورهای مختلف است. راهکارهای پیشگیری از بزهکاری در میان این گروه سنی به ویژه در فضای مدارس و نیز ضرورت اقدامات موثر در زمینه رسیدگی به بزههای ارتکابی این افراد از جمله مهمترین مسایل در این زمینه هستند. در سالهای اخیر شکلگیری تمایلات گسترده به اجرای فرایندهای عدالت ترمیمی در حوزههای مختلف، سبب شده است که زمینههای لازم برای اعمال رویکردهای ترمیمی در رسیدگی به جرائم دانشآموزان فراهم شود. مهمترین مرجعی که به اجرای بهتر و مؤثرتر این روند کمک خواهد کرد مدارس هستند زیرا مدارس با بهرمندی از بازوهای توانمندی همچون اولیا، مربیان و دانشآموزان میتوانند فرایندهای ترمیمی مشخصی مانند میانجیگری مدرسهای و نشستهای ترمیمی را به خوبی اجرا کنند. روش: روش پژوهش حاضر، توصیفی و تحلیلی است. منابع پژوهش شامل تجارب سایر کشورها در اجرای فرایندهای ترمیمی در مدارس و ظرفیتهای موجود در آموزش و پرورش ایران بود. جمعآوری دادهها به روش کتابخانهای انجام شد. همچنین در بعضی موضوعات با مسئولان تربیتی و مدیران مدارس درخصوص تجارب آنان درباره شیوههای ترمیمی در رسیدگی به جرائم دانشآموزان مصاحبه شد. یافتهها و نتایج: ایجاد مدارسی مبتنی بر عدالت ترمیمی نیازمند انجام اقداماتی است که اگرچه در ظاهر دشوار و هزینهبر به نظر میرسند اما میتوانند جامعه را از صرف هزینههای بیشتر در زمینه تعقیب و مجازات بزهکاران در آینده مصون بدارند. این روند با تکمیل رسالت تربیتی و پرورشی مدارس، میتواند از آنچه برای نوجوانان و افراد مرتبط با آنها چالش و تهدید محسوب میشود، فرصتهای مغتنمی بسازد که اثرات آن در حال و آینده زندگی دانشآموزان و خانوادههای آنها و بهبود کیفیت محیط مدارس و برنامههای آن، قابل مشاهده خواهد بود.
Background and aim: Juvenile delinquency is a phenomenon that has always been a concern of politicians and jurists in different countries due to its specific sensitivities. Criminal prevention strategies are among the most important issues in this age group, especially in the school environment, and the need for effective measures to deal with the crimes committed by these individuals. In recent years, the widespread tendency to implement restorative justice processes in different areas has provided the necessary background for applying remedial approaches to student crime. The most important source that will help this process run more efficiently are schools because schools with good arm strengths such as parents, educators, and students can execute specific healing processes such as school mediation and healing sessions. Method: The research method is descriptive and analytical. Research sources included other countries' experiences in implementing restorative processes in schools and existing capacities in Iranian education. Data collection was done by library method. There were also interviews with educational officials and school principals on some of their experiences on student remedial practices. Findings and conclusion: Creating schools based on restorative justice requires actions which can save society from spending more on prosecuting and punishing future criminals. By complementing the educational mission of schools, this process can create opportunities and opportunities for teens and their dependents, providing opportunities that impact the current and future lives of students and their families and improve the quality of the school environment and its programs.
