Abstract:
زمینه و هدف: یکی از ارزش‌ها و حقوق افراد جامعه برقراری نظم اجتماعی است. رفتارهای مخالف نظم اجتماعی بر اساس زمان، نیازها و هدف‌های آن در تغییراند این قانون‌گذار است که بنا به مصلحت یا ضرورت اجتماعی هر زمان که تشخیص دهد می‌تواند رفتارهای مخالف نظم اجتماعی را تحریم و ضد اجتماعی تلقی کند.
مواد و روش‌ها: این تحقیق از نوع نظری بوده روش تحقیق به صورت توصیفی تحلیلی می‌باشد و روش جمع‌آوری اطلاعات بصورت کتابخانه‌ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است.
ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است.
یافته‌ها: استدلال‌های فقها در خصوص خسارت تاخیر از قوت لازم برخوردار نیست. اگر مشروعیت دریافت این خسارت از زاویه عدالت و انصاف نگریسته شود استدلال فقها در این خصوص تقویت می‌شود.
نتیجه‌گیری: نقض یک تکلیف اخلاقی یا شرعی می‌تواند به پدیده جنایی تبدیل شود. در نتیجه وجود خسارت تاخیر تادیه می‌تواند هم به نوعی بازدارندگی ایجاد کند و هم مانع ایجاد خسارت‌های آینده شود و هم خسارتی جبران نشده باقی نماند.
Background and Aim: One of the values and rights of individuals in society is to establish social order. Behaviors contrary to social order change according to time, needs and goals. It is the legislator who, according to the social interest or necessity, can consider anti-social order behaviors as sanctions and anti-social at any time. Materials and Methods: This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles. Ethical Considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed. Findings: The jurists' arguments about the damages of delay are not strong enough. If the legitimacy of receiving this compensation is viewed from the perspective of justice and fairness, the argument of the jurists in this regard will be strengthened. Conclusion: Violation of a moral or religious duty can become a criminal phenomenon. As a result, the existence of late payment damages can both provide a kind of deterrent, prevent future damages, and leave no irreparable damages.
