Abstract:
شرکتهای لیزینگ در دنیا از روشهای متنوعی جهت تامین و تخصیص منابع استفاده مینمایند ولی در ایران این روشها کمتر موردتوجه قرار میگیرد. یکی از این روشها که اشکال مختلفی نیز دارد، عاملیت است. عاملیت یکی از شیوههای نوین در تجهیز و تخصیص منابع شرکتهای لیزینگ میباشد. با توجه به اینکه تخصص اصلی این شرکتها در انجام امور اعتباری است، این ظرفیت میتواند جهت کمک به افزایش توان بنگاهها و همچنین تامین مالی آنها استفاده گردد. شرکتهای لیزینگ در این فرایند میتوانند نقش دوگانهای را ایفا نمایند. اولا، بهعنوان عامل نقش وصول مطالبات را برعهده بگیرند، ثانیا با توجه به حجم بالای حسابها و اسناد دریافتنی در صورتهای مالی خود میتوانند با تعامل با یک شرکت عامل که توان اعتباری مناسبی دارد موجبات دسترسی بیشازپیش خود را به وجه نقد فراهم گردانند.
مقاله حاضر که با روش توصیفی- تحلیلی و با رویکردی فقهی صورت پذیرفته پس از بیان ماهیت و اقسام عاملیت از منظرهای گوناگون، به تبیین انواع روشهای کاربردی آن در شرکتهای لیزینگ پرداخته است. با توجه به اینکه فرایند عاملیت، خواه شرکت لیزینگ بهعنوان کارفرما باشد؛ خواه در نقش عامل، ترکیبی است از فعالیتهای مختلف ازجمله وصول مطالبات، تامین مالی و ترکیبی از این دو، عقودی که در این جهت میتواند مورداستفاده قرار گیرد، مانند بیع دین، وکالت، جعاله و ضمان از منظر فقهی مورد واکاوی قرارگرفته است. ازآنجاکه عقود نامبرده شاکله اصلی فرایند عاملیت را تشکیل میدهند و مطابق با ارزیابی فقهی که در این مقاله از این عقود انجامگرفته، مانعی جهت بهکارگیری آنها وجود ندارد، میتوان استفاده از روش عاملیت جهت تجهیز و تخصیص منابع را در شرکتهای لیزینگ مدنظر قرار داد.
Leasing companies in the world use various methods to finance and allocate resources, but in Iran these methods are less considered. One of these methods, which has different forms, is factoring.Factoring is one of the new methods in equipping and allocating resources to leasing companies. Given that the main specialty of these companies is in credit affairs, so this aspect can be used to help increasing the capacity of firms as well as their financing. Leasing companies can play a dual role. First, they can be as a factor and collect receivables from manufacturing companies. Second, given the high volume of receivables in their financial statements they can discount and sell them to the factor with high credit ability to gain more access to cash.This article, which has been done with a descriptive-analytical method and with a jurisprudential approach, after expressing the nature and types of factoring from different views, has explained the various methods of its application in leasing companies. the factoring process; whether the leasing company as an employer or factor; is a combination of different activities such as collection of claims, financing and combination of them. In this research, contracts that can be used in factoring, such as buying debt, wakalah, Ju'alah and Guarantee have been studied from a jurisprudential perspective. Since the mentioned contracts constitute the main structure of the factoring and according to the jurisprudential assessment of these contracts, there is no obstacle to use them, the factoring is suitable for financing and allocating resources in leasing companies.
