Abstract:
الشروع هو الجریمة الناقصة التی تخلف فیها أحد عناصر المتممة للجریمة) النتیجة الإجرامیة (، ویقتصر نطاق الشروع علی الجرائم العمدیة فقط دون غیرها، وعلیه تخرج من نطاقه الجرائم غیر العمدیة، وجرائم الخطر التی یتعاقب علیها بمجرد ارتکاب الفعل، والجرائم السلبیة. فعند تطبیق القواعد العامة علی الجرائم الواردة فی قانون مکافحة الجرائم الالکترونیة القطری یتبین أن الجرائم التی یتعاقب علیها بالشروع هی؛ جنایة تزویر المحررات الالکترونیة، والاحتیال الإلکترونی، وذلک لصراحة المشرع. والجدیر بالذکر فی هذا السیاق، أنه لا یتصور الشروع فی جمیع الجنایات، حیث إن جنایة التعدی علی الأنظمة المعلوماتیة الخاصة بالدولة لا یتصور فیها الشروع، کونها من جرائم الخطر التی سبق وأن ووحنا أنها تخرج عن نطاق الشروع. وعلیه، یتعاقب المشرع من شرع فی ارتکاب تلک الجرائم بالحبس مدة لا تجاوز نصف الحد الأقصی للعقوبة المقررة، فی حین قد یتعاقب من ارتکب الجریمة التامة بالغرامة فقط دون الحبس، إعمالاً لسلطة القاضی التقدیریة فی تفریده للعقوبة.
Attempt is the incomplete crime in which one of the complementary elements of the crime (the criminal outcome) is
missing. The scope of attempt is limited to intentional crimes only, and not others, and accordingly, unintentional crimes,
dangerous crimes that are punishable once the act is committed, and negative crimes are excluded from its scope.
When applying the general rules to the crimes mentioned in the Qatari Cyber Crime Law, it becomes clear that the
attempted crimes punishable by law are: The felony of forgery of electronic documents, and electronic fraud, as stated by the
legislator.
It is worth noting in this context that it is not conceivable in all felonies, as the felony of infringing on the information
systems of the state is not conceivable for attempting, as it is one of the dangerous crimes that we have previously made clear
that it falls outside the scope of attempt.
Accordingly, the legislator shall punish anyone who attempts commit these crimes with imprisonment for a period not
exceeding half the maximum penalty prescribed, while the person who commits the crime may be punished with a fine only
without imprisonment, according to the authority of the judge to individualize punishment.
