Abstract:
تتمحور الفکرة الرئیسیة للمقال حول الحدیث عن المقتضیات الزجریة للقانونین القانون رقم 16. 98 و القانون رقم 47. 14 لحمایة الجسم البشری من خلال الاعتداءات الواقعة علیه لأن ذلک یشکل مساسا بالجسم کله، غیر أن السعی نحو تطویر العلاجات الطبیة لیس دائما بهذه الصورة الوردیة، إذ عن قصد أو بدونه قد یجنح الباحثون فی المجال الطبی نحو مسالک قد یختلط فیها العلم بالمحظور القانونی، أو قد یصطدم بالوازع الدینی أو الأخلاقی، فإن هو خرج عن السیط رة تأذت البشریة أیما أذی، فیتحول التطور الطبی من نعمة إلی نقمة ومن إشراق إلی أفول قد یهدد الاستمرار الطبیعی للجنس البشری. ولتحقیق الحمایة لأعضاء وأنسجة هذا الجسم فقد أحاطت التشریعات ومنها المشرع المغربی الأعضاء والأنسجة البشریة بحمایة خاصة من خلال إصداره للقانون 16. 98 المنظم لعملیات الاستئصال والزرع والمحدد للشروط والمسطرة الواجب إتباعها من أجل القیام والاستفادة من هذه العملیات فی إطار قانونی سلیم یضمن الحفاظ علی السلامة الجسدیة لکل من المتبرع والمتبرع له کما ینحی المسؤولیة عن الطبیب الذی یقوم بها علی اعتبا ر أنه یقوم بعمل مرخص له به قانونا. و کذلک القانون رقم 47. 14 المتعلق بالمساعدة الطبیة علی الإنجاب.
