Abstract:
تلاش برخی علمای عضو مجلس شورای ملی در حاکمیت مبانی شرع بر نظام قانونگذاری که به تصویب و اجرای اصل دوم متمم قانون اساسی مشروطه تحت عنوان اصل طراز، انجامید از حیث آثار حقوقی در نظام حکمرانی یکی از نقاط عطف تاریخ حقوق اساسی ایران است . در این میان شیخ حسین یزدی که در زمره فقهای مشروطه خواه مکتب سامرا و نجف و از نمایندگان نخستین ادوار مجلس شورای ملی است و در تاسیس فقهی و حقوقی نظام سیاسی برآمده از جنبش مشروطیت نقش موثری ایفا کرد در تدوین اولین قانون اساسی و متمم آن در مجلس اول همراه با تصویب نخستین قوانین نهادساز حقوقی نظیر قوانین عدلیه و بلدیه و... که با تاکید به نظارت شرعی علمای طراز اول بر روند قانونگذاری است، بمثابه فقیه ای قانونگذار، نظام قانونگذاری مشروطه را از مجرای فقه و اصول امامیه می گذراند و ضمن صیانت از موازین شرع در امر قانونگذاری، سازه های نظام حقوقی نوین را نیز بر پایه سنت حقوقی هزارساله این قوم استوار می کند. از این رو، او علاوه بر نقش موثری که در تدوین و تصویب اصل طراز در مجلس اول دارد به جهت پیگیری مداوم در اجرای مفاد آن و سرانجام تهیه لایحه اجرایی-تفسیری اصل مذکور نقش ممتازی را در تبیین و تثبیت آن ایفا نموده است که بنظر می رسد علاوه بر اعتقاد دینی، تجربه عملی این نماینده ادوار نخستین مجلس در استواری قوانین شریعت محور موجب اهتمام وی جهت تثبیت و اجرای اصل دوم متمم قانون اساسی بوده است.

The drafting of the first constitution and its amendment in the first parliament along with the approval of the first legal institution-building laws such as justice and municipal laws, etc., which emphasize the religious supervision of top scholars on the legislative process, a figure of Sheikh Hossein Yazdi as a legislative jurist It allows the constitutional legislative system to pass through the path of Imami jurisprudence and principles in order to protect the sharia standards in the matter of legislation, and to establish the structures of the new legal system based on the millennial legal tradition of this people Therefore, in addition to the effective role he plays in the formulation and approval of this principle in the first parliament, he has played a special role in explaining and establishing the implementation of its provisions in order to continuously follow its implementation and finally prepare an executive-interpretative bill. It seems that in addition to religious belief, the practical experience of this member of the first parliament in the stability of Sharia-based laws has led to his efforts to establish and implement the second principle of the constitutional amendment.
