Abstract:
تجارت الکترونیکی و مباحث نظری آن، همچنان در کشورهای توسعه نیافته، حوزهای فانتزی محسوب میشوند که توجه پژوهشگران متعددی را به سوی خود جلب کردهاند. باید توجه داشت که تجارت در مفهوم و مفاد خود عملیات را دارد و صرف بررسی علمی موضوع، موجب پیشرفت عملی تجارت الکترونیکی نمیشود. انواع مختلف قراردادهای الکترونیکی، پرداختهای الکترونیکی و مالیات تجارت الکترونیکی، مسئولیت مدنی در این نوع از تجارت، انعقاد قراردادها در تجارت الکترونیکی و نیز بحث وضعیت تجارت الکترونیکی در ایران، از مباحث اصلی تجارت الکترونیکی در این مقاله محسوب میشوند. بنابراین، مقاله حاضر با این هدف نگارش شده است که تجارت الکترونیکی، بخشی جدایی ناپذیر از حقوق تجارت و حقوق مدنی در مفهوم سنتی آن محسوب میشود و در نظر دارد که مسائل مختلف حقوق تجارت الکترونیکی را با تکیه بر رویه قضایی و تجاری بررسی کند. این مقاله با بررسی جایگاه قراردادها و حقوق تجارت الکترونیکی در زمینه حقوق فضای مجازی محدود شده است. نتیجه چنین رویکردی، سادگی این گرایش از یک سو و کاربردی بودن مباحث مطرح در آن، از سوی دیگر است.
E-commerce and its theoretical topics are still considered fantasy fields in underdeveloped countries, which have attracted the attention of many researchers. It should be noted that business has operations in its concept and content, and mere scientific study of the subject does not lead to the practical development of e-commerce. Different types of e-contracts, e-payments and e-commerce taxes, civil liability in this type of business, concluding contracts in e-commerce and also discussing the situation of e-commerce in Iran, are the main topics of e-commerce in this article. Therefore, the present article has been written with the aim that e-commerce is an integral part of commercial law and civil law in its traditional sense and intends to examine various issues of e-commerce law based on judicial and commercial practice. This article is limited to examining the status of contracts and e-commerce law in the field of cyberspace law. The result of such an approach is the simplicity of this tendency on the one hand and the applicability of the issues raised in it on the other hand.
