Abstract:
در این پژوهش به تبیین و کنکاش درخصوص جرم اخفای طفل بر مبنای سیاست کیفری ایران در قبال جرایم اخفاءو پنهان کاری پرداخته می شود. اخفا را در اصطلاح حقوق جزا، به پنهان کردن شخص، مال یا ماهیت واقعی مال، با هدف مجرمانه تعریف می نمایند. مخفی نمودن به خودی خود جرم محسوب نمیشود؛ اما گاهی موضوع اخفاء عملی است که نظم عمومی را به مخاطره انداخته و قانون گذار برای جلوگیری از آن، این عمل را جرم انگاری نموده و برای آن مجازات تعیین می نماید. در مورد ربایش نوزاد (تازه متولد شده) تنها در برخی از نظامهای حقوقی و از جمله ایران قانون خاص تصویب شده است. لذا در این رهگذر عناصر متشکله جرم اختفای طفل از منظر فقهی و حقوقی مورد مداقمه قرار می گیرد.با توجه به مطالب معنونه، در مقام جمع بندی باشد بیان داشت که، مشهور فقها در مورد ربودن کودک به شرط عدم فروش آن قائل به تعزیر هستند امّا اگر سارق کودک را بفروشد بر اساس نظر اکثر، مجازات وی قطع دست است؛ در قانون نیز ربودن و اختفاء کودکان ممنوع بوده و برای مجازات حبس و همچنین جزای نقدی در نظر گرفته شده است. در قانون نیز برای این مورد مجازات، حبس در نظر گرفته شده است.
In this research, the crime of hiding a child is explained and researched based on Iran's criminal policy towards hiding crimes and secrecy. Concealment is defined in criminal law terms as the concealment of a person, property, or the actual nature of property for a criminal purpose. Hiding is not a crime in itself; but sometimes it is a matter of concealing an act that endangers public order and the legislature, to prevent it, criminalizes this act and determines the punishment for it. A special law has been passed regarding the abduction of a (newborn) baby only in some legal systems, including Iran. Therefore, in this passage, the constituent elements of the crime of hiding a child from a jurisprudential and legal perspective are examined.In terms of meaningful content, in conclusion, he stated that the famous jurists believe in abducting a child on condition that he does not sell it, but if the thief sells the child, according to the majority, his punishment is amputation; The law also prohibits the abduction and hiding of children and provides for imprisonment as well as fines. The law also provides for imprisonment for this case.
