Abstract:
چکیده محجوریت، خواه حمایتی باشد و خواه سوءظنی، نداشتن اهلیت برای تصرف در حقوق خویشتن است. شارع مقدس به دلیل حمایت از محجورین، اصل بر اعمال ولایت قهری بر مولی علیه قرار داده است.اختیارات اعطایی گسترده به ولى قهری با دو قاعده رعایت صلاح و نبودن مفسده محدود شده است .اختیارات ولی قهری در قانون گسترده است و تنها چیزی که این اختیارات را محدود میکند، مصلحت شخصی است که محجور شده و نیازمند ولایت است. بنابراین ولی قهری حق ندارد عملی انجام دهد که برخلاف مصلحت یا متضمن ضرری برای محجور باشد. این مقاله با استفاده از روش توصیفی و تحلیلی به آسیب شناسی حوزه اختیارات ولی قهری از منظر فقه اسلامی و حقوق ایران پرداخته است.اگر معلوم شود که استفاده نکردن از حق شفعه نتیجه تقصیر ولی، وصی و قیم و اهمال آنها در اداره دارایی مولی علیه بوده یا با خریدار در تضییع حق محجور تبانی کرده است و همچنین در موردی که ولی نتواند مصلحت یا ضرورت ویژه ای را برای اقدام خود اثبات کند، بیگمان تفریط او نیروی اسقاط حق شفعه را ندارد.و اگر ثابت شود که تقصیری رخ نداده و اقدام ولی برای جلوگیری از مفسده بوده است (مانند اینکه بهای فروش سهم شریک گزاف باشد، می توان کار او را نافذ شناخت.
AbstractAbstinence, whether supportive or suspicious, is the inability to seize one's rights. The Holy Shari'a, in order to protect the absentees, has established the principle of coercive guardianship over the property. It limits the authority, it is the personal interest of the one who is deprived and needs the province. Therefore, coercion does not have the right to do something that is against the interest or involves harm to the detainee.Using a descriptive and analytical method, this article deals with the pathology of the jurisdiction of the guardian from the perspective of Islamic jurisprudence and Iranian law.If it turns out that the non-use of the right of pre-emption is the result of the fault of the guardian, guardian and custodian and their negligence in managing the financial assets or colluding with the buyer in wasting the dispossessed right and also in case the guardian fails to exercise special interest or necessity To prove himself, of course, his debauchery does not have the power to abolish the right of pre-emption.
