Abstract:
زمینه و هدف: برای رفع مشکل ناباروری امروزه از روش‌های درمان متعددی از جمله اهدا تخمک استفاده می‌شود. روش‌های نوین باروری اما دارای ابعاد فقهی، حقوقی و اخلاقی مختلفی است که همواره محل بحث و نظر بوده است. در این مقاله تلاش شده به بررسی فقهی خرید و فروش و به عبارت دقیق‌تر تجاری‌سازی اهدای تخمک پرداخته شود. مواد و روش‌ها: مقاله حاضر توصیفی تحلیلی بوده و از روش کتابخانه‌ای استفاده شده است. ملاحظات اخلاقی: در این مقاله، اصالت متون، صداقت و امانت‌داری رعایت شده است. یافته‌ها: یافته‌های تحقیق حاکی است بر اساس استنباط از دیدگاه فقها، در فقه درخصوص خرید و فروش تخمک اختلاف‌نظر وجود دارد. تعارض با اصل کرامت انسانی، فقدان رابطه مالکیت میان فرد و تخمک و فقدان مالیت عرفی از دلایل مخالفت با خرید و فروش تخمک است. قواعدی چون اصل سلطنت انسان بر خود، رفع عسر و حرج در زندگی برخی زوجین، ضرورت انجام کار خیر و اصل برائت نیز به عنوان دلایل موافقت قابل استناد است. نتیجه: دلایل موافقت به معنای پذیرش تجاری‌سازی تخمک قلمداد نمی‌شود. در واقع، انتقال تخمک به‌صورت اهدای آن پذیرفته شده و قابل دفاع است و این با آنچه از تجاری‌سازی به ذهن متبادر می‌شود، متفاوت است. اهدای تخمک راه‌حل میانه‌ای میان ممنوعیت مطلق انتقال تخمک از یک سو و جواز خرید و فروش و تجاری‌سازی تخمک از سوی دیگر است. در این راهکار میانه، هم بحث عسر و حرج رفع می‌شود و هم خرید و فروش به معنای تجاری‌سازی که مغایر اصل کرامت انسانی است صورت نمی‌گیرد.
Background & Objective: In order to solve the problem of infertility, many treatment methods are used today, including egg donation. Modern fertility methods, however, have many jurisprudential, legal, and ethical aspects that have always been the subject of debate. In this paper, an attempt is made to jurisprudentially investigate the purchase and sale, and more precisely, commercialization of egg donation.Ethical Considerations: In this paper, the originality of the texts, honesty, and trustworthiness are observed.Findings: Findings of the research indicate that based on the inference from the point of view of jurists, there is a disagreement in jurisprudence regarding the purchase and sale of eggs. The conflict with the principle of human dignity, the lack of ownership relationship between the individual and the egg, and the lack of customary ownership are some of the reasons for opposing the purchase and sale of eggs. Rules such as the principle of man's sovereignty over himself, removing distress and constriction in the lives of some couples, the necessity of doing good deeds, and the presumption of innocence can also be cited as reasons for agreement.
