Abstract:
حق زنان در باروری و انعقاد نطفه در رحم در ازدواج از نظر روایت و هم از منظر حقوق انسانی در عصر کنونی محل بحث و نظر است. بسا یکی از زوجین بعد از ازدواج تمایل و یا عدم تمایل به فرزندآوری، تأخیر، تنظیم و یا تحدید نسل بدون مشورت و هماهنگی از طریق عزل یا یکی از روشهای متداول امروزی دارد که موجب نزاع در میان زوجین و سبب ایجاد پروندههای قطور در مراجع قضایی گاهی نیز به طلاق در میان زوجین منجر خواهد شد. بهدلیل عدم اهمیت آن در زمان گذشته، فقهای متأخرین در کتابهای فقهی باب مستقلی به آن اختصاص ندادهاند. اما امروزه با پدیدة دنیای مجازی، دهکدة جهانی و تهاجم رسانههای غربی به نادیده گرفتن حق زنان در اسلام، بیان اهمیت موضوع در عصر حاضر ضرورت دارد. این تحقیق با احصا و تحلیل دیدگاه مذاهب چهارگانۀ اهل سنت و امامیه و نظرهای فقهای معاصر فریقین با بررسی ادلة عقلی و استنباط از روایات نقلی، درصدد جواب این مسئله است که آیا با ازدواج، حقی برای زن در فرزندآوری ایجاد خواهد شد یا خیر؟ نتیجة تحقیقات نشان میدهد که زنان در باروری ذیحقاند و فرزندآوری حق مشترک بین زوجین است.
The women’s right to fertility and coagulation of sperm in the womb in marriage is a matter of debate in terms of narrative and human rights in the present era. Maybe, one of the spouses intends to have a child, to delay having child, or to control birth without counseling and making agreement through dismissal or any other modern conventional methods. This may cause dispute among the spouses and create voluminous cases in judicial authorities and sometimes may lead to divorce. Due to its lack of importance in the past, no independent section has been dedicated to this subject by the earlier jurists. But today, the phenomenon of the virtual world, the global village, and the invasion of the western media to ignore the rights of women in Islam, make it necessary to explain the importance of the issue in the present era. This research gathers and analyzes the views of four Sunni and Imami schools of thought as well as the opinions of the modern jurists of the two Islamic sects. It also reviews the rational evidences and narrations in order to address the question of whether the woman will be given any right to have a child through marriage contact. The results of the research show that women have the right to be fertility and having child is a shared right between couples.
