Abstract:
آثار داستانی معاصر فارسی به عنوان گنجینه ای غنی و پربار، دارای ظرفیّت ها و قابلیّت های گوناگونی است و این مجموعه را از دیدگاه های مختلف و با رویکرد های متفاوت می توان مورد مطالعه و تحقیق قرار داد. مباحث متعددی همانند جامعه شناسی، حقوق و روان شناسی در ادبیّات داستانی نهفته است. با درنگ در این آثار از منظر علم حقوق، به ویژه دانش جرم شناسی به عنوان علمی نوپا و چند بعدی می توان تحقیقاتی را به انجام رساند که تلفیق تجربه ها و روش ها و بهره گیری همزمان از دستاوردهای هر دو رشتهً زبان و ادبیاتِ فارسی و حقوق را به ارمغان آورد و گامی بلند در جهت مطالعاتِ میان رشته ای برداشت. با این نگاه، در مقاله پیش رو، رمان روزگار سیاه اثر عباس خلیلی به عنوان یکی از نخستین نمونه های رمان اجتماعی که در پاسخ به مقتضیات روز جامعهٔ ایرانی دردورة پهلوی اوّل پدید آمده بود با نگاهی جرم شناختی مورد بررسی و تحلیل قرار خواهد گرفت. نویسنده در این اثر به واسطۀ نگاه نقّادانۀ اجتماعی و توصیفات زنده و دردناک به ترسیم خوفناک وضعیّت زن ایرانی پرداخته است. دستاورد این مقاله که به روش تحلیلی-توصیفی و بر مبنای روش کتابخانه ای به انجام رسیده است بیانگر آن است که آثار داستانی معاصر فارسی دارای آموزه های حقوقی و رهیافت های آسیب شناختی در زمینۀ مسایل مرتبط با دانش جرم شناسی و علل وقوع جرایم می باشد که تبیین صحیح آنها و خوانشِ درستِ این گزاره ها و مفاهیم حقوقی، پیوند میان رشته ای ادبیّات و حقوق و در نتیجه عاملی موثّر در پیشگیری از جرائم و اصلاح فرد خواهد بود.
Contemporary Persian fiction works as a rich and fruitful treasure, has various capacities and capabilities and this collection can be studied and researched from different perspectives and with different approaches. Numerous topics such as sociology, law and psychology are embedded in fiction. By contemplating about these works from the perspective of jurisprudence, especially criminology as a nascent and multidimensional science, research can be done that combines experiences and methods and simultaneously use the achievements of both Persian language and literature and he brought law and took a big step towards interdisciplinary studies. In the present article, the novel Black Times by Abbas Khalili as one of the first examples of social novels that emerged in response to the requirements of Iranian society in the first Pahlavi period will be examined and analyzed from a criminological point of view. In this work, the author has depicted the horrible situation of Iranian women through a socially critical view and vivid and painful descriptions. The achievement of this article, which has been done analyticallydescriptively and based on the library method, indicates that contemporary Persian fiction works have legal teachings and pathological approaches in the field of issues related to criminological knowledge and the causes of crimes. The correct explanation of them and the correct reading of these legal propositions and concepts, bring the interdisciplinary link between literature and law and, consequently, the effective formulation of legal laws and regulations, and will be an effective factor in preventing crimes and reforming the individual.
