Abstract:

دریافت سود ازشروط مهم در بازار سرمایه می باشد. در بازار سرمایه ایران وبعضی کشورهای اسلامی قوانین ضد ربوی وجود دارد ولی باتوجه به اهمیت قراردادهای سرمایه گذاری وسود بانکی افراد حاضر به قرار دادن سرمایه خود در اختیار دیگران بطور رایگان نیستند وسرمایه گذاران سرمایه خود را در جایی بکار می برند که بیشترین سود ودر آمد را برای آنان داشته باشد وسود آنان دچار افت وکاهش نشود. پس این سوال مطرح می شود که جایگاه سود از دیدگاه متفکران مسلمان کجاست؟ هدف این تحقیق بررسی جایگاه فقهی ربا و سود بانکی از نگاه متفکران جهان اسلام و بررسی سود، در بازار سرمایه می‌باشد. منابع تحقیق ازطریق اسناد کتابخانه ای وبصورت فیش برداری جمع آوری شده است وتجزیه وتحلیل اطلاعات بصورت کیفی می باشد.در این تحقیق مشروعیت سود از دیدگاه علمای اسلام مورد بررسی قرار گرفت. ودر این زمینه متخصصان مسلمان عقود شرعی را پیشنهاد نموده اند.ودر این تحقیق به این نتیجه منتهی شد که دریافت سود بر اساس عقود اسلامی ایرادی ندارد. ودربانکداری اسلامی معاملات ربوی حرام، ولی قراردادهایی راکه درچارچوب موازین شرعی وعقود اسلامی باشد مجاز است.
