Abstract:
قانون‌گذاری به مثابه فعلی برنامهریز در زمینه تحقق احکام شرعی یا ماهیتی کارشناسانه و موضوعشناسانه برای احکام شرعی یا هویت تقنین در منطقهالفراغ امری است که نمیتوان آن را جدای از جامعه و اقتضائات آن در نظر انگاشت. واقعیات اجتماعی گاه جنبه کاتالیزر برای تقنین اسلامی دارد و گاه مانعی برای تقنین یا اجرای قانون مبتنی بر شرع است. به هر روی، نگرش فقهی به ابعاد حقوق عمومی قانون‌گذاری و امکان و امتداد توجه به جامعه‌‌پذیری قانون و نیز جواز و گستره سکوت در قانون‌گذاری، به عنوان مسئله این نوشتار، امری است که فعل قانون‌گذاری را در محک جامعهشناسی فقهی قرار می‌دهد و دو راهبرد ضرورت جامعه‌‌پذیری قانون و سکوت قانون (در برابر تورم در تقنین) را پیش مینهد. اهمیت این نوشتار توصیفی ـ تحلیلی و کتابخانهای از آن روست که عمدتاً با نگاه کلنگر تجزیهناپذیر به شریعت، بدون توجه به بسترهای اجتماعی، تمرکز بر تورم قانون‌گذاری و فهم جایگاه مجلس شورای اسلامی به عنوان منشأ زاینده و پویای هنجارسازی بوده است. نوشته پیش‌آیند، ضمن آسیبشناسی این روند، به راهبرد تدریج (جامعه‌‌پذیری قانون) و ضرورت (سکوت نسبت به تقنین و در تقنین) مبتنی بر مبانی و مستندات فقهی و حقوقی دست یافته است.

Social realities have sometimes been a catalyst for Islamic legislation and sometimes an obstacle to legislation or the implementation of sharia law. However, the jurisprudential attitude to the dimensions of public law and the possibility and extension of attention to the sociability of law, as well as the permission and extension of silence in legislation, as the issue of this paper, is what has put the act of legislation in the test of jurisprudential sociology. And the two strategies advance the necessity of the socialization of the law and the silence of the law (against inflation in legislation). The importance of this descriptive-analytical paper, using a library method is due to the fact that it mainly tries to multiply legislation with an integral view of Sharia, regardless of social contexts, and the necessity of the position of the Islamic Consultative Assembly as a productive and dynamic source of normalization. While the pathology of this process, has achieved a strategy of gradual (sociability of law) and necessity (silence towards legislation and in legislation) based on jurisprudential and legal principles and documents.
