Abstract:
سازمان‌های مردم نهاد با ماهیت حرفهای و غیرسیاسی خود، نقشی اساسی در ترویج توسعه پایدار و حمایت از مطالبات قانونی شهروندان دارند و با ارائه رویکردهای نوآورانه و مردم محور برای ارائه خدمات، حمایت و توانمند سازی مورد تحسین قرار گرفتهاند اما این سازمان‌ها در جامعه ایران در وضعیت نابه سامانی قرار دارند به گونهای که در شیوه تاسیس، نظارت، تامین مالی و انحلال خود با چالش‌های بسیاری مواجه هستند که این خود، تضعیف حوزه عمومی را به دنبال خواهد داشت. رهایی از واقعیت موجود و حرکت به سمت وضع مطلوب مستلزم به کارگیری استانداردهایی است که می‌تواند پیامدهای مثبتی را برای سازمان‌های مردم نهاد به همراه داشته باشد. هدف از پژوهش حاضر بررسی مولفه‌های به سامانی در ارتباط با سازمان‌های مردم‌نهاد در قوانین و مقررات سه کشور ایران، ارمنستان و کانادا است. پژوهش حاضر به لحاظ هدف توصیفی و روش تحقیق آن، به صورت جمع آوری اطلاعات از طریق مطالعه کتابخانهای و جمع آوری آراء و اسناد معتبر حقوقی و نیز بررسی و تحلیل محتوای این اسناد خواهد بود. یافته‌های پژوهش نشان می‌دهد ارمنستان قوانین و مقررات جامعی را برای حمایت از فعالیت سازمان‌های مردم‌نهاد تصویب کرده و ساختارها و کمیته‌های رسمی را برای حضور و مشورت با نهادهای مدنی تدارک دیده است. ضمن اینکه با بهره‌گیری از ابزارهای فیزیکی، مجازی و فرایندهای رسمی ظرفیت‌هایی برای مشارکت سازمان‌های مردم‌نهاد فراهم کرده است. در کشور کانادا قانون مستقلی در رابطه با سازمان‌های مردم‌نهاد وجود ندارد و این سازمان‌ها مطابق با "قانون سازمان‌ها و شرکت‌های غیرانتفاعی" فعالیت می‌کنند. ایران هم کماکان از عدم وجود یک قانون جامع برای فعالیت سازمان‌های مردم‌نهاد رنج برده و ساختارهای خاص مستحکمی برای جلب مشارکت این سازمان‌ها وجود ندارد.
Non-governmental organizations, with their professional and non-political nature, play a fundamental role in promoting sustainable development and supporting the legal demands of citizens, and they have been praised for providing innovative and people-oriented approaches to providing services, support and empowerment, but these organizations in Iranian society, they are in a state of disarray in such a way that they face many challenges in the way of establishment, supervision, financing and liquidation, which will lead to the weakening of the public sphere. Getting rid of the existing reality and moving towards the desired situation requires the application of standards that can bring positive consequences for non-governmental organizations. The aim of the current research is to investigate the components of enhancement in relation to non-governmental organizations in the laws and regulations of three countries: Iran, Armenia and Canada. The research has been carried out in terms of descriptive purpose, in terms of library method and based on the analysis of rules and regulations. The findings of the research show that Armenia has adopted comprehensive laws and regulations to support the activities of non-governmental organizations and has prepared official structures and committees to attend and consult with civil organizations. In addition, by using physical and virtual tools and official processes, it has provided capacities for the participation of NGOs. In Canada, there is no independent law regarding non-profit organizations and these organizations operate according to the "Non-profit Organizations and Corporations Act". Iran continues to suffer from the lack of a comprehensive law for the activities of non-governmental organizations and there are no strong specific structures to attract the participation of these organizations.
