Abstract:
مسئولیت پزشک در نظام حقوقی ایران مسئولیت پزشکی، پاسخگو بودن پزشک در قبال خسارات و زبان روحی و معنوی است که به بیمار وارد میآورد و این خسارات، ناشی از انجام وظایف پزشکی است. پذیرش تقابل خطر این ایده را مطرح میکند که هرگاه شخص به طور ضمنی یا صریح، خطر آسیب وارده از جانب دیگری را بپذیرد، به علت زیان وارده نمیتواند از فاعل زیان مطالبه خسارت کند. به همین دلیل در این پژوهش، تفاوت اصلی پذیرش خطر را از قاعده تقصیر زیان دیده(یا خطای مشارکتی در حقوق انگلیس) نشان میدهد که مسقط ضمان است و به عنوان یک سبب بر رابطه سببیت بین زیان وارده و فعل خوانده اثر میگذارد. از میان انواع مبانی مسئولیتِ پزشکان، در فرآیند کم و بیش پیچیده و پر فراز و نشیب اعمال پزشکی، تئوری خطر به عدالت و مصلحت اجتماعی جامعه هدف، نزدیکتر است.مطابق نظریه خطر یا مسئولیت بدون خطا اصل بر این است که چنانچه ضرری وارد شود پزشک مرتکب تقصیر و خطا شده است مگر اینکه ثابت شود هیچگونه قصوری واقع نگردیده است. در این حالت تعهد پزشک به بیمار یک نوع تعهد به نتیجه است چرا که در صورت عدم بهبودی بیمار یا بروز عوارض ،چنین فرض میشود که پزشک به وظیفه خود به درستی عمل نکرده است.
