Abstract:
درتقابل حقوق ملی با تعدد سیستمهای دوجانبه که در آنها برای حل مساله ای دایره شمول قانون جستجو میشود که رابطه بدلیل ماهیت درآن پایگاه دارد و نیز تنوع روشهای حل تعارض، زمینه های ظهور و بروز احاله محل گفتگوست. با تعدد سیستمها، دلیل توجیهی احاله درجه یک و اصل پذیرش احاله درجه دو و با تنوع سیستمها، اصل وجودی آنها مساله ساز است. میتوان با روش توصیفی تحلیلی و با بهره مندی از آوردههای حقوق تطبیقی برای حل این مسائل ارائه راهکار نمود: در تقابل با سیستمهای دوجانبه، نباید بریکی از دو معیار «هماهنگی راهکارها» و «قاعده حل تعارض مقردادگاه» پافشاری نمود. چه صرف معیار قرارگرفتن مورد نخست باعث کاهش بیش از حد موارد پذیرش احاله و درنتیجه، کاهش سرعت و دقت و مانعی برای شناسایی آراست و نقطه پرگار قرارگرفتن مورد دوم، ناهماهنگی راهکارها را بهمراه دارد. درتقابل با تنوع روشها، باید تایید شود قاعده یکجانبه حوزه شمول قانون یک کشور را در مکان بدون ارجاع به قانون خارجی مشخص میکند. بنابراین اگر قاعده خارجی یکجانبه باشد، احاله و اگر قاعده ایرانی یکجانبه باشد، ارجاع و در نتیجه احاله ای درکار نیست. در موضوع قواعد هدفمند و روش گزینش قانون مناسب، مطلوب واضع قاعده، قانون ماهوی صالح است. در این شرایط، حسب بهرهمندی سیستم مقر دادگاه یا سبب از این روشها، رخداد یا تداوم احاله اتفاق نمی افتد.

Justification for first-degree renvoi and the principle of accepting second-degree renvoi and with variety of systems its existential principle is problematic.solution can be provided to solve problems by descriptive-analytical method and by using the data of comparative law:In contrast to bilateral systems, one should not insist on one of two criteria"coordination of solutions" and"rule of dispute resolution of the seat of court".What is criterion of being the first to reduce the number of renvoi acceptances much, and thereupon, is reduce in speed and accuracy and obstacle to identification of Votes and the compass point of the second case brings with it the inconsistency of the solutions.In contrast to variety of methods, must be approved unilateral rule,without reference to foreign law, specifies the scope of country's law in place.So if the external rule is unilateral, renvoi and if the Iranian rule is unilateral, if Iranian rule is unilateral,comission and thereupon no renvoi. In the method of purposeful rules and Selection of the Appropriate Law wanted to establish the rule is competent substantive law. In these circumstances, occurrence or continuation of renvoi, depending on the benefit of court headquarters system or cause of such methods, isn’t appropriate.
