Abstract:
با وجود تلاشهای دولت در طول سالیان متمادی، اصناف در دستیابی به جایگاه و نقش اصلی خود رادر جامعه تا حدود زیادی ناموفق عمل نمودهاند. این نقوص محصول وجود قوانین ناکافی، مجمل، متضاد و ناکارآمد و بخش عمده دیگر، ماحصل عدم تضمین این مساله در نزد مجریان قانون از جمله قضات میباشد.لذا از این جهت اهمیت دارد که بررسی شود مراجع قضایی تاچه حد در تضمین این حقها موفق بودهاند؟. مراجعی مانند دیوان عدالت اداری، علیرغم حمایت نسبی از حقوق و آزادیهای این حوزه، پیرامون عمده مصادیق حقوق صنفی از قبیل؛ محدودیتهای حاکم بر پیوستن به صنف و اشتغال، تشکلها و سایر حقوق، به رویه مشخصی دست نیافته است. این تشتت در قسمت قوانین نیز وجود دارد. لذا با اعطای استقلال عمل بیشتر به قضات ،اصلاح، شفافسازی و بروز رسانی قوانین و بازتاب آن در آراء وحدت رویه هیئت عمومی دیوان عدالت اداری، توانمند سازی و عدم تصدیگری توسط دولت میتوان به صیانت بهتر از حقوق و آزادیهای صنفی امیدوار بود.
Despite the government's efforts over many years, guilds have been largely unsuccessful in achieving their main position and role in society. These defects are the product of the existence of insufficient, general, conflicting and ineffective laws, and the other major part is the result of the failure to guarantee this issue in the eyes of law enforcers, including judges. Therefore, it is important to check to what extent the judicial authorities have been successful in guaranteeing these rights. ? Authorities such as the Court of Administrative Justice, despite the partial support of the rights and freedoms of this field, around the main examples of trade union rights such as; The restrictions on joining the guild and employment, organizations and other rights have not reached a specific procedure. Therefore, by giving more autonomy to judges, amending, clarifying and updating the laws and reflecting it in the unanimous decisions of the General Board of the Administrative Court of Justice, empowering and not taking over by the government, we can hope for better protection of trade union rights and freedoms.
