Abstract:
تعیین مجازات اهمیت بسیاری در سیاست جنایی سنجیده و هدفمند دارد. مروری بر سرقت‌های تعزیری آشکار می‌سازد که در نظام حقوقی ایران منطق خاصی بر تعیین مجازات این‌گونه جرایم حاکم نیست و در این جرایم بسیاری از مجازات‌های نامتناسب از حیث نوع و میزان و ناکارآمد از جهت تحقق اهداف وجود دارند. کیفرهای کلیشه‌ای و بی‌قاعده نه فقط موجب عدم تامین اهداف مجازات می‌شوند، بلکه بر بزهکار تأثیراتی نامطلوب و معکوس هم دارند. تعیین مجازات مناسب و درجه بهینه آن که بیشترین کارایی را دارا باشد، امری بسیار پیچیده و نیازمند توجه به معیارهای بسیاری است. این مقاله تاکید دارد که قانون-گذار در سرقت‌های تعزیری مقدم بر هر امری باید هدف اصلی خود را از مجازات تعیین نماید و نوع آن را با توجه به آن هدف برگزیند و با توجه به مبانی حقوقی، فلسفی، سیاسی و جامعه شناختی مبادرت به وضع کیفر نماید. در خصوص میزان مجازات نیز قانون‌گذار باید به سهولت و منافع ارتکاب سرقت، رقم سیاه بزهکاری، عمومیت جرم و ارتباط سرقت با دیگر جرایم توجه کند و در عین حال در راستای فردی سازی مجازات و افزایش تأثیر مثبت مجازات دست قاضی را در تعیین میزان مجازات باز بگذارد.
