Abstract:
وقف از احکام تأسیسی اسلام نیست بلکه یک امر عرفی است که حدود و شرایط آن را عرف و بنای عقلا تعیین میکند. این نهاد خیریه ریشه در فطرت انسان دارد. سابقه وقف به قدمت تاریخ اجتماعات بشری است. در میان قدیمترین اقوام و جوامع انسانی و در ادیان گذشته و حتی در میان بت پرستان عقود شبیه به وقف و نذر وجود داشته است. با ظهور اسلام این امر عرفی و انسانی مورد تأیید و امضای شرع انور قرار گرفت و با تحول معنوی که در مقاصد و شرایط آن ایجاد شد علاوه بر انگیزه های غریزی و انسانی انگیزه قویتری با عنوان تقرب به خداوند به این امر عرفی قداست ویژه ای بخشید و منشأ برکات فرا وانی شد و در بخشهای حقوقی، اقتصادی، تربیتی و عبادی اسلام جایگاه خاصی یافت. وقف از چنان ظرفیتی برخوردار است که میتواند همه همنوعان از جمله غیرهمدینان را نیز زیر پوشش خود قرار دهد. جمعی از فقهای بزرگ قصد قربت را در صحت وقف شرط نمیدانند، و حتی جمعی دیگر وقف برای کفار غیر محارب را محکوم به صحت میدانند. و این همه، نشانه ظرفیت و پویایی این نهاد مردمی و سنت نبوی است.
Waqf is not one of the founding rules of Islam, but it is a customary matter that
determines its limits and conditions by custom and rationality. This charitable institution
is rooted in human nature. The history of waqf is as old as the history of
human societies. Among the oldest tribes and human societies, in past religions and
even among pagans, there have been contracts similar to waqf and vows. With the
advent of Islam, this customary and human thing was approved and signed by the
holy religion and with the spiritual transformation that was created in its purposes
and conditions, in addition to instinctive and human motives, a stronger motive called
closeness to God gave special holiness to this common practice and it became the
source of many blessings and found a special place in the legal, economic, educational
and religious sectors of Islam. Waqf has such a capacity that it can cover all
people including non-believers. A group of great jurists do not consider the intention
of closeness as a condition for the validity of the waqf and even some other groups
consider waqf for non-enemy infidels to be correct and all this is a sign of the capacity
and dynamism of this popular institution and prophetic tradition.
