Abstract:
در مخاصمه میان دو یا چند کشور، برخی از دولتها اعلام بیطرفی مینمایند. اتخاذ این رویکرد دولت بیطرف را از یکسری حقوقی برخوردار و در مقابل، تکالیفی را نیز متوجه آن میسازد. با توجه به افزایش کاربرد تحریم و تأثیر آن بر حقوق بشر مردم کشورهدف، این مقاله به دنبال یافتن پاسخ به این سؤال است که آیا دولت بیطرف بهلحاظ حقوق بینالملل مجاز به اعمال تحریم علیه یکی از کشورهای متخاصم میباشد؟ و اساساً ارتباط میان رویکرد بیطرفی و تحریم چگونه تفسیر میشود؟ نوشتار حاضر با مطالعۀ موردیِ سوئیس بهعنوان کشوری برخوردار از بیطرفی دائمی، با استفاده از روش توصیفی_تحلیلی این فرضیه را بهآزمون میگذارد که در عصر حاضر، پارادایم بیطرفی مشابه بسیاری از مفاهیم و رویکردهای بینالمللی عمدتاً متأثر از اقتضائات و منافع سیاسی، امنیتی و اقتصادی کشورها، تفسیر میشود و منافع مزبور ابعاد حقوقی بیطرفی را به موضوعی ثانویه تقلیل میدهد. مضافاً اینکه فشارهای بینالمللی و منطقهای، حتی کشورهای بیطرف دائم را نیز ناگزیر از مشارکت در تحریمها مینماید. نتیجه اینکه، با ادامۀ چنین روندی انتظار میرود رویکرد بیطرفی در آینده از مفهوم سنتی فاصله گرفته و دامنهاش از قابلیت تفسیر بیشتری برخوردار گردد.
AbstractIn conflicts between two or more countries, some governments declare neutrality. Adopting this approach gives the neutral government a series of rights and also imposes duties on it. Considering the increasing use of sanctions, this article seeks to find an answer to this question that; regarding international laws, is the neutral government allowed to impose sanctions against one of the hostile countries? Basically, how is the approach between neutrality and sanctions interpreted? By studying Switzerland as a country with permanent neutrality, using the descriptive-analytical method, this article tests the hypothesis that in the present era the neutrality paradigm, similar to many international concepts and approaches, is mainly interpreted under the influence of the political, security and economic interests of countries and the aforementioned interests reduce the legal dimensions of neutrality to a secondary issue. Furthermore, international and regional pressures force neutral countries to participate in sanctions. With the continuation of such a trend, it is expected that the approach of neutrality will move away from the traditional concept in the future and its scope will be more interpretable.
