Abstract:
قرارهای تامین کیفری در حقوق ایران و انگلستان با توجه به سیستم حقوقی متفاوت رومی ژرمنی و کامن لا تا حدود زیادی متفاوت هستند و ماهیت و مبنای صدور آنها و مقامات و مراحل اصدار آنها از وجوه افتراق و اشتراک برخوردارند . به طور کلی قرار های تامین کیفری با هدف تضمین حضور متهم در زمان و مکان مشخصی صادر می گردند و تنوع این قرار ها با توجه به قانونBail Act 1976 و ماده 217 قانون آیین دادرسی کیفری مصوب 4/12/92 با اصلاحات بعدی متفاوت می باشد . در حقوق انگلستان انضمام شروطی به قرار وثیقه یا کفالت پیش بینی شده است و همچنین برخورداری از قرار کفالت و وثیقه به عنوان حقی برای متهم شناسایی شده است و صدور هر نوع از آنها قابل اعتراض بوده و این در حالی است که در حقوق ایران بازداشت ناشی از صدور دو قرار مزبور و قرار بازداشت موقت قابل اعتراض می باشند .در خصوص مقامات صالح در اصدار قرارهای تامین ، در حقوق ایران دادستان ، دادیار ، بازپرس و قاضی دادگاه و در حقوق انگلستان قاضی دادگاه های مجستریت و دادگاه جزا و استیناف صلاحیت داشته و یکی از مهم ترین تفاوت های موجود ، تفویض اختیار صدور قرار تامین به ضابطان ( پلیس ) در حقوق انگلستان بر خلاف حقوق ایران است .
