Abstract:
لقد آضحی الحق فی محاکمة عادلة یعد من هم الحقوق التی ینعم بها الانسان علی الاطلاق، وهو ما یظهر من حقیقة |قرار الکثیر من موائیق حقوق الانسان الدولیة والاقلیمیة والدساتیر وقوانین الوجراءات الوطئیة لهذا الحق. ویکتدسب الق فی محاکمة عادلة آهمیة خاصة فی (طار الدعوی اجنائیة حیث انه یعد وسیلة لا غنی عنها خمایة حیاة الافراد وحریاتهم وامنهم الشخصی التی قد یتم انتهاکها نتیجة للاجراءات التی تخضع لها هذه الدعوی و نتیجة لتعرض الفرد للعقوبة اجنائیة علی ید الدولة من دون وجه حق وذلک عن طریق تزوید التهم بالضمانات الاجرائیة التی تکفل عدم تضرر موقفه با تتلکه الدولة من موارد مادیة وبشریة وفنیة ف مواجهته وهو ما من شانه آن یکفل -فی امحصلة النهائیة- حسن سیر العدالة امنائیة. وحیث ان الملکة العرییة السعودیة قد تبنت خلال سنوات العقد الماضی جموعة من الانظمة التی تهدف الی تعزیز حمایة حقوق الانسان فی الملکة وعلی راسها الحق نی محاکمة جنائیة عادلة، فان هذه الدراسة تسعی الی التعرف علی اذا ما کانت نصوص تلک الانظمة تلبی مقتضیات الق ف محاکمة جنائیة عادلة ف ظل القانون الدولی حقوق الانسان وتقدیم الفترحات التی من شانها الاسهام فی دفع عملیة التطویر التی یشهدها نظام العدالة اجنائیة نی الملکة فیما یتعلق بالسائل التعلقة جوضوع هذه الدراسة لی الآمام.
The right to a fair trial has become one of the most important rights that individuals enjoy. This is
evident from the fact that many international and regional treaties, as well as national constitutions and procedural
laws guarantee this right. The right to a fair trial is particularly important during the criminal process because it
represents an indispensible means to protect the life, liberty and security of persons who are charged with
committing criminal offences, which might be otherwise violated as a result of miscarriages of justice or the
State’s exercise of its coercive powers during the criminal process. The role of the right to a fair trial in the
criminal process is, thus, to provide individuals involved in such proceedings with procedural safeguards that
guarantee that individuals are not at a substantial disadvantage vis-a-vis the State, and, which, will, in the end,
ensure the proper administration of justice.
Since the Kingdom of Saudi Arabia has adopted during the previous decade a number of statutes that aim to
enhance the protection of human rights in the Kingdom and in particular the right to a fair trial in the criminal
process, this study seeks to examine the provisions of these statutes to determine the extent to which, in relation to
the right to a fair trial in criminal proceedings, they conform to international human rights standards, and to
provide suggestions which could help push forward the reform process which the Saudi criminal justice system is
currently undergoing.
