Abstract:
مسئله مشارکت سیاسی در جوامع بشری، یک مسئله عام و فراگیر است و کمتر روزی را می‌توان یافت که در رسانه‌های جمعی، مطبوعات و حتی گفتگوهای روزمره حرفی از حقوق بشر و مشارکت مردم در سرنوشت دولت‌ها در میان نباشد. در ایران نیز به‌ویژه پس از انقلاب اسلامی مشارکت سیاسی به‌خصوص رفتار رأی‌دهی، از توجه شایانی برخوردار گردید. در ساختار سیاسی و حقوقی ایران در قالب اصول قانون اساسی و همچنین قوانین حوزه حقوق عمومی در بخش های مختلف ابزارهای تحقق مشارکت سیاسی با محدودیت هایی پذیرفته شده است. لذا هدف این مقاله تحلیل و واکاوی جایگاه مشارکت سیاسی در قانون اساسی جمهوری اسلامی ایران است. در این راستا با استفاده از روش کتابخانه ای به بیان شاخص‌های مشارکت سیاسی و ساز و کارهای آن در قانون اساسی و همچنین به بررسی انتخابات به عنوان یکی از مؤلفه‌های مشارکت سیاسی در قانون اساسی پرداخته شد. بررسی ها حاکی از این است که؛ قانون اساسی جمهوری اسلامی به‌عنوان اصلی‌ترین سند تضمین حقوق و آزادی‌ها به طور صریح یا ضمنی نقش مشارکت سیاسی مردم را به عنوان یک حق برای آن‌ها برمی‌شمرد و حدود آن را تعیین می کند. نظام جمهوری اسلامی و قانون اساسی آن بارأی مردم ایجادشده است و در عین حال انتخاب رهبر به صورت غیرمستقیم و انتخاب رئیس‌جمهور و نمایندگان مجلس شورای اسلامی، شرکت در همه‌پرسی‌ها تجلی حضور و مشارکت سیاسی عموم مردم ازجمله همه اقلیت‌ها و قومیت‌ها در امر اداره حکومت، مشارکت در پیشبرد امور کشور است.
The issue of political participation is general and comprehensive in human communities and it is rarely found a day when it is not talked about human rights and people’s participation in governments’ fate in the mass media, the press, and even everyday conversations. In Iran also, especially after the Islamic Revolution, political participation and specifically voting behavior grabbed particular attention. In the Iranian political and legal structure, the different means of realization of political participation have been accepted, though with some barriers, in the framework of the constitution and the laws in the area of public rights. Thus, the present study aims to analyze and explore the position of political participation in the constitution of the Islamic Republic of Iran. To do so, the indicators of political participation and its mechanism in the constitution were expressed using library studies. Besides, the election as one of the components of political participation in the constitution was investigated. the results indicate that the constitution of the Islamic Republic of Iran as the main document to guarantee rights and freedoms explicitly or implicitly enumerates the people’s political participation as a right for them and determines its boundaries. The Islamic Republic system and its constitution are created by the people’s votes and in the meantime, the election of the Supreme Leader indirectly as well as the president’s selection and selection of members of the Islamic Consultative Assembly, and participation, in the government administration and participation in the advancement of the country's affairs.
