Abstract:
تناول البحث توصيف التجارة الإلكترونية من منظور شرعيء ووضع أسسًا عامة للعقود المالية التي تجري في المواقع الإلكترونيةء لا سيما مع انتشار التجارة الإلكترونية التي باتت جزءًا مهمًا من حياة الإنسان المعاصر. بدا البحث بالحديث عن التجارة الإلكترونية من حيث تعريفهاء وتاربخهاء وتطورهاء وأهم خصائصهاء وآلياتها. ثم ناقش الباحث التجارة الإلكترونية في ميزان الشريعة الإسلاميةء فذكر الشروط العامة للعقود الماليةء وذكر أهم القواعد الفقهية المتصلة بالتجارة الإلكترونيةء ثم فصل في ذكر الشروط المتعلقة بالعاقدين› والشروط المتعلقة بالصيغةء والشروط المتعلقة بالمعقود عليهء كما عرض الباحث المعيار الشرعي الجامع للمعاملات المالية الذي أصدرته هيئة المحاسبة والمراجعات للمؤسسات المالية الإسلاميةء ثم خصص مبحنًا للحديث عن حماية التعاملات المالية المبرمة بالإنترنت» والمعايير الشرعية المتعلقة بهذا الأمر. وقد جمع البحث بين المنهج الوصفي من خلال تحديد المسائل العلمية ووصفها على حقيقتهاء والمنهج الاستدلالي في ذكر أدلة كل مسألةء وخلص البحث إلى أهمية التجارة الإلكترونية في الزمن المعاصرء مع الالتزام بالمعايير الشرعية للمعاملات المالية؛ للابتعاد عن سلبيات التجارة الإلكترونيةء وأن إبرام العقود المالية بواسطة الإنترنت لا يختلف عن إبرام العقود بالطرق التقليدية؛ إذ الأصل فيها الإباحة، ما دامت الوسائل شرعية أيضًا.
The research dealt with describing e-commerce from a legal perspective, and laying down a general basis for financial contracts that take place on websites, especially with the spread of e-commerce, which has become an important part of modern human life. The research began by talking about e-commerce, in terms of its definition, history, development, most important characteristics, and mechanisms. Then the researcher discussed e-commerce in the balance of Islamic law, mentioning the general conditions for financial contracts, and the most important jurisprudential rules related to e-commerce, then detailing the conditions related to the two contracts, the terms related to the formula, and the conditions related to the contracts on it. The researcher also presented the comprehensive legal standard for financial transactions that It was issued by the Accounting and Auditing Organization for Islamic Financial Institutions, then it devoted a topic to talking about the protection of financial transactions concluded with the Internet, and the Sharia standards related to this matter. The research combined the descriptive method by identifying and describing the scientific issues for what they are, and the inductive method in mentioning the evidence for each issue. The research concluded the importance of e-commerce in the contemporary age, while adhering to the Sharia standards for financial transactions, to move away from the negative aspects of e-commerce, and that the conclusion of financial contracts via the Internet is not different from concluding contracts by traditional methods, as the principle is permissibility, as long as the means are also legitimate.
