Abstract:
به حکم عقل و تایید و تاکید شریعت اسلام ، جان انسان مصون و محفوظ از تعدی و تجاوز است ؛ لذا اگر کسی خواسته یا ناخواسته جنایتی بر جسم و جان دیگری وارد کند، ملزم به جبران و تدارک خسارات وارده می باشد. اگر چه ممکن است تعیین دقیق خسارات وارده به ویژه در جایی که جنایت بر جان دیگری است امری دشوار و یا حتی غیر ممکن باشد، اما بر اساس مبانی فقهی ، اغلب فقهای اسلام معتقدند که تدارک خسارات با توجه به نوع جنایت در شریعت اسلام معین و مقدر بوده که از آن به « دیه » تعبیر شده است ، به طوری که کاستن یا افزودن بر آن میزان مقدر بنا به هر دلیلی مجاز نمی باشد. اغلب فقها براین عقیده اند که خسارات مازاد بر دیه از سوی جانی قابل مطالبه نیست، اما نگارنده در این نوشتار با استناد به ادله مختلفه از جمله قواعد مسلم فقهی و دلیل عقلی به این نتیجه دست یافته است که قابل مطالبه بودن خسارات مازاد بر دیه با عدالت سازگارتر است.
According to the rationality and confirmation and emphasizing on the Islamic religion، the human's soul is secure and safe from oppression and aggresion.
So if someone damages other's body and soul، deliberately or undeliberately، he had to compensate it. Hence it is possible to assign damage carefully. Specially، it is difficut or impossible to damge other's soul. But in according to the jurisprudence essentials، most of the Islamic jurists believe that، the preparation of damage is detemined، (but in regard to the kind of crime) which called the blood money while it isn't permissible to increase or decrease that destined extent، for any reason، most jurists believe we should not demand the damages surplus to the blood money. But according to the different reasons e.g certain religious principles and intellectual reasons، the writer concluded، it is more agreeable to demand the damages surplus to the blood money.
