"هذا المعیار لیس مانعا جامعا،بحیث یکفی دون‌ الالتجاء الی غیره من المعاییر للتمییز بین الضبط الاداری‌ و الضبط القضائی أما بالنسبة للمعیار الشکلی،فأن قضاء مجلس الدولة الفرنسی قد جری‌ علی أن المعیار الممیز للضبط الاداری عن الضبط القضائی، یکمن فی النظر الی السلطة القائمة علی اتخاذ الاجراء الضبطی،فاذا کانت السلطة القائمة باتخاذ الاجراء احدی‌ سلطات الضبط الاداری،کان‌ العمل ضبط اداری،و اذا کان‌ القرار صادر من السلطة القضائیة کان قرارا قضائیا أما بالنسبة لقضاء مجلس‌ الدولة المصری،فالمستفاد من‌ أستقرار أحکام محکمة الاداریة العلیا،أنه قد أخذ المعیار الموضوعی،و یقوم علی المعیار الموضوعی،و یقوم علی أساس‌ أن وظیفة الضبط الاداری هی‌ منع الجرائم قبل وقوعها و ذلک‌ بأتخاذ التدابیر الوقائیة و أحتیاطات الامن،أما وظیفة الضبط القضائی فهی البحث عن‌ الجرائم و ترکیبها و جمع‌ الاستدلالات اللازمة للتحقیق‌ و الدعوی. رأینا: مع تقدیرنا لسلامة الاعتبارات التی بینت علیها المعاییر السابقة،الا أننا نری فی‌ مجال التمییز بین کل من نوعی‌ النشاط الضبطی القضائی‌ و النشاط الاداری لسلطات‌ الضبط النظر الیها من خلال‌ معینة موضوعی یتصل بطبیعة العمل و الغایة منه،فاذا کان‌ القائم به قد أتخذ و قام به بأعتباره‌ مساعدا للقضاء،فی اداء مهمة هدفها خدمة العدالة و کشف‌ الجرائم و تتبع مرتکبیها أو التحقیق منهم أو للمحاکمة أو حتی فی مجال تنفیذ العقوبة المحکوم علیهم بها،فالعمل‌ ضبط قضائی أما اذا کان العمل‌ قد اتخذ فی اطار دون أن یکون‌ هدفها البحث عن الجرائم‌ و مرتکبیها و جمع الاستدلالات، و اتجه الی تحقیق النظام العام‌ و الامن و السکینة و الصحة و الرخاء القومی و النشاط الاقتصادی أو السیاسی أو کان‌ حمایة للنظام العامالخلقی‌ و المبادی‌ء أو القیم الاجتماعیة السائدة فالعل من أنشطة الضبط الاداری."
