Abstract:

شرط یکی از منابع مهم تعهد در فقه امامیه و حقوق ایران است.تخلف از شرط توازن معاملاتی را به هم می‌ریزد.از همین‌رو طرف زیاندیده به ضمانت اجراهای تخلف روی می‌آورد تا دوباره قرارداد را متعادل سازد.ضمانت‌های مندرج در قانون مدنی‌ که به پیروی از فقه وضع شده‌اند،گاه از تأمین این هدف ناتوان بوده و حتی به ضد خود تبدیل می‌شوند.در این مقاله با نقد رویکرد سنتی و ارائه تحلیلی جدید از ماهیت شرط به این باوریم که شرط گاه حق دینی ایجاد کرده و ذمه مشروط علیه را به‌ خود مشغول می‌سازد و گاه حق عینی پدید آورده و معاملات معارض با خود را باطل و دست کم غیرنافذ می‌سازد.

"1-دلایل مخالفت دلایل مخالفت با تقویم شرط و مطالبه بهای آن را می‌توان به ترتیب زیر برشمرد: 1-1-عدم تقسیط ثمن بر شرط مشهور فقیهان با این استدلال که در معاملات معوض مبادله در حقیقت بین عوضین(دو مورد معامله)صورت می‌گیرد و شرط نقش مستقلی در قیمت‌گذاری ندارد منکر حق مطالب بهای شرط شده‌اند، به گفته آنان معوضه عرفا بین ذات عوض و معوض صورت می‌گیرد نه ذات به اضافه صفات یا ذات به‌ علاوه شروط. علامه حلی که در ادبیات مکتوب فقه به ظاهر نخستین قائل این نظریه است در کتاب تذکره‌ الفقهاء تصریح می‌کند که هرگاه موضوع شرط صفتی باشد که موجب ازدیاد قیمت موصوف مطلق و موصوف مشروط)را مطالبه نماید و هرگاه مورد شرط فعلی از افعال باشد که مشروط علیه از ایفای‌ آن امتناع می‌ورزد سه گزینه فسخ،اجبار و عوض ایجاد می‌گردد(نجفی خوانساری،1241:952)و (انصاری،بی‌تا:582)و(نجفی،بی‌تا:ج 32،022). ماده 642 تصریح می‌کند:در صورتی که معامله به واسطه اقاله یا فسخ به هم بخورد شرطی که‌ در ضمن آن شده است باطل می‌شود اگر کسی که ملزم به انجام شرط بوده است عمل به شرط کرده‌ باشد می‌تواند عوض او را از مشروط له بگیرد. حال در چنین وضعیتی حکم شرط چیست؟گذشته از این‌ که بعضی شرطی را اصولا به دلیل غیر قابل تسلیم بودن یا نامشورع بودن باطل‌ می‌دانند،بنا بر نظر قائلین به صحت،آیا مشروط له به جز حق فسخ می‌تواند مطالبه عوض نیز بنماید؟بر همان منوالی که تاکنون تحلیل و بررسی شد،بدون تردید شرط مزبور نیز قابل‌ تقویم است و لذا در فرض مذکور با این فرض که ملک مزبور قابل تملک باشد می‌بایست‌ قیمت‌گذاری و عوض آن از مشروط علیه مطالبه شود."
