چکیده:
زمینه و هدف: رازداری و حفظ حریم خصوصی مراجع از اصول بنیادین و ارکان مهم رابطه درمانی و اخلاق حرفهای در حوزه فعالیتهای روانشناختی و مشاورهای است. روانشناسان و مشاوران بنا به وظیفه حرفهای و قانونی خود موظف به حفظ اسرار مراجعین خود هستند. هدف از پژوهش حاضر، تبیین ابعاد رازداری و افشای اسرار در حوزه خدمات رواندرمانی و مشاوره و تحلیل قوانین موجود در این حوزه است.
مواد و روشها: در این پژوهش، نظامنامه اخلاقی سازمان نظام روانشناسی و مشاوره و قوانین مربوطه مورد بررسی و تحلیل قرار گرفته است.
یافتهها: با توجه به نظامنامه اخلاقی سازمان نظام روانشناسی و مشاوره و مواد قانونی، روانشناسان و مشاوران ملزم به حفظ اسرار مراجعین خود هستند. بر همین اساس، چنانچه روانشناس یا مشاور اسرار مراجعین خود را افشا نماید، مسوولیت قانونی متوجه اوست، البته باید توجه داشت که رازداری امری نسبی است و ممکن است شرایطی به وجود آید که متخصص به موجب قانون ملزم به نقض رازداری و افشای اطلاعات مراجعین خود شود.
ملاحظات اخلاقی: صداقت و امانتداری در گزارش متون و اسناد به منابع رعایت گردید. این پژوهش با هزینه شخصی انجام شده و فاقد هرگونه حمایت مالی میباشد.
نتیجهگیری: این مطالعه حاکی از آن است که رازداری و حفظ حریم خصوصی مراجعین موضوعی است که در ایران مغفول مانده است، در این خصوص کاستیهای قابل توجهی در نظامنامه اخلاقی و قوانین وجود دارد که با توجه به مسائل و چالشهای جدید نیازمند بازنگری هستند. ضمنا لازم است مباحث اخلاق حرفهای و رازداری در سرفصلهای آموزشی و دورههای بازآموزی مد نظر قرار گیرد.
Background and Aim: Confidentiality and privacy are references to
fundamental principles and important pillars of therapeutic relationship and
professional ethics in the field of psychological and counseling activities.
Psychologists and counselors are required to protect their clients' secrets in
accordance with their professional and legal duty. The purpose of this study was
to explain the dimensions of confidentiality and disclosure of secrets in the field
of psychotherapy services and to consult and analyze the existing laws in this
area.
Materials and Methods: In this research, the ethical code of the organization of
psychology and counseling and related laws has been analyzed.
Findings: According to the ethical code of the organization of the psychological
and legal system, psychologists and counselors are required to maintain the
secrets of their clients. Accordingly, if a psychologist or counsel discloses the
secrets of his clients, he has a legal responsibility. Of course, it's important to
note that confidentiality is relative and that there may be circumstances in which
a specialist, under the law, is required to violate the confidentiality and
disclosure of his clients' information.
Ethical Considerations: Integrity and honesty in reporting, ducumanting citing
of resourdes were observed. This research is carried out at personal expense
without any financial support.
Conclusion: This study suggests that confidentiality and privacy of the clients is an
issue that has been neglected in Iran. There are significant deficiencies in the ethics
code and laws that need to be reviewed in light of new issues and challenges. At the
same time, professional ethics and confidentiality issues should be considered in the
curriculum and retraining courses.
