چکیده:
To check the legitimacy of states, there are rules which are developed through decades under customary international law. Some of these rules that are required to form a new state are shortly introduced in this research. The required elements of statehood are closely examined with a focus on the establishment of Israel in 1948. Also, Stimson Doctrine of United States which has made a ban on any recognition of a state that is formed based on force and injustice is discussed, and finally, the legitimacy of Israel is discussed under the Jewish jurisprudence, if this country is based on the claim of return to promised land. The methodology applied in this research is limited to the scope of legal interpretations and analysis. Other aspects of legitimacy of Israel under non-legal fields are not being taken into consideration in this paper.
