چکیده:
بازاریابی شبکه ای روشی نوین در تجارت امروزی است و به عنوان معامله ای مستقل می تواند مورد بررسی قرار گیرد ؛ هرچند ممکن است تشابهاتی میان عناوین اجاره ، جعاله، و صلح با بازاریابی شبکه ای وجود داشته باشد . در طرح های مختلف بازاریابی شبکه ای شایبه هایی چون شانس ، ریسک و خطرپذیری، فریب، عدم تلاش در کسب درآمد، و خروج سرمایه از کشور وجود دارد و از این رو شبهاتی چون قمار ، اکل مال به باطل، و غرری بودن این گونه معاملات مطرح می گردد؛ به خصوص در انواعی که چرخه آنها بدون رد و بدل شدن کالا و یا تبادل کالاهای لوکس با قیمت های غیرواقعی، تعریف شده اند، این اشکال ها به طور جدی قابل توجه است. با توجه به اثرات منفی مستقیم و غیرمستقیمی که این فعالیت ها به ویژه از نوع دوم آن در شبکه اقتصادی جوامع می گذارد، علاوه بر شبهات مذکور، مهم ترین عنوانی که در تحدید آن از جانب دولت اسلامی می تواند مد نظر قرار گیرد، حکم ثانوی حفظ نظام و مصلحت آن است. در این مقاله ضمن اشاره به انواع بازاریابی شبکه ای، مشروعیت یا عدم مشروعیت آن مورد بحث و بررسی قرار می گیرد. آنچه می توان گفت این که بازاریابی شبکه ای به دلیل اکل مال به باطل، قمار، غرر، و اختلال در نظام، مشروعیت ندارد و به عنوان کسب حرام که نتیجه آن بطلان است، مطرح می گردد.
Network marketing is a new method in today's trading، which can be studied as an independent transaction، although there might be some similarities between such topics as ijāra (lease)، ju‘āla (hire)، ṣulḥ (conveyance)، and network marketing.
In various network marketing projects، there are suspicions like chance، taking risks، deception، lack of attempt in earning an income، and withdrawal of capital from the country; thus، such doubts as gambling، consuming property wrongfully، and uncertainty of these transactions are put to discussion; especially in the types of transactions whose cycles are defined without exchange of goods or exchange of luxurious goods with unreal Given the direct and indirect destructive effects that these activities، especially of the second type، have on the economic networks of societies، besides the above-mentioned misconceptions، the most important title that can be taken into consideration by the Islamic state in delimiting it is the secondary decree of preserving the ruling system and its expedience. While referring to various types of marketing networks، this article addresses their legitimacy or illegitimacy. What we can say is that network marketing is not legitimate due to its consuming property wrongfully، gambling، uncertainty، and disruption in the system and is propounded as an unlawful (ḥarām) occupation، which ends up in invalidity.
