Abstract:
تتحدّث الدراسة عن الملاحظات الّتي أبداها صاحب الحدائق في موسوعته الفقهیّة القیّمة: «الحدائق الناضرة» بشأن عدد من مناهج فقهائنا المتأخّرین وآرائهم من نحو ملاحظاته علی المدرسة الحلّيّة في أخذهم حینًا بعمل الأصحاب في حالة عدم ورود نصّ في المسألة ورفضهم ما ذهب إلیه الأصحاب إذا كان مستندهم ممّا یناقشه فقهاء هذه المدرسة.
كما یتعقَّبُ البحرانيّ صاحب المعالم عندما طعن في الإجماع في موضع یُعلم المخالف فیه في الوقت الّذي أقرّوا في أبحاثهم الأصولیّة أنّ مخالفة معلوم النسب لا یقدح في حجّ یّة الإجماع.
ویأتي في السیاق نفسه انتقاد البحرانيّ للمتأخّرین المنصبّ علی عدم الفحص اللّازم عن أدلّة المسألة في مظا اّهن حیث اقتصروا في مواضع كثیرة علی مراجعة كتاب تهذیب الأحكام للشیخ الطوسيّ -مث -ًال وهو خالٍ عن دلیل المسألة، فأنكروا وجود النصّ فیها في حین أنّ روایات المسألة قد وردت في مصدر آخر.
ومن الطریف أن نجد البحرانيّ یضع تحت المجهر بعض آراء الشیخ محمّد بن الحسن الحرّ العامليّ في موسوعته: وسائل الشیعة -وهو ممّن ینتمي إلی المدرسة الأخباریّة نفسها الّتي ینضوي البحرانيّ تحت لوائها- لیخلص أخیرًا إلی ضعف بعض انطباعاته عن الأحادیث.
The present study tackles the notes raised by the writer of the valuable
fiqh encyclopedia ‘’Al-Hada’iq Al-Nadhira’’ for/against the approaches
followed by late scholars and their views. Among these notes is the view of
Al-Hilli school which first worked upon (the opinions of the companions)
to reach a legal judgment through reasoning and then rejected such opinions
once the school discussed the different views. Al-Bahrani also talked over
the issued raised by the writer of ‘’Al-Ma’alim’’ who discredited the believers
in ‘’Consensus’’ that diverges from the essence of truth, who themselves
maintained in their usul studies that ‘’divergence from the essence
of truth does not discredit Consensus’’. In addition, Al-Bahrani criticized
late scholars not being able to scrutinize sufficiently each and every legal
issue by itself. In this regard, late scholars in many situations rested upon
reviewing, for instance, Al-Tusi’s ‘‘Tahdib Al-Ahkam’’ which is devoid of
justification for/against legal issues. Due to this in particular, such scholars
denied the existence of authentic wordings, whereas these wordings are
found in another source. Likewise, Al-Bahrani considered the views of the
Akhbarist Sheikh Mohammad bin Al-Hassan Al-Hur Al-Amili in his encyclopedia
‘’Was’il Al-Shia’’, stating that some of the Sheikh’s impressions
are weak regarding Hadiths.
